Hobbs, Chair N.F. Nicholls, Commissioner October 5, 2005 O R D E R WHEREAS: A. By Application dated September 30, 2005, Sea Breeze Pacific Regional Transmission System, Inc. (“Sea Breeze”) requested that the B.C. Utilities Commission (“the Commission”) grant a Certificate of Public Convenience and Necessity (“CPCN”) for the Vancouver Island Cable Project (“VIC”) to construct a High Voltage Direct Current (“HVDC”) Light ® transmission system between Vancouver Island and the Lower Mainland (“the VIC Application”); and B. The VIC would be a new 550 MW HVDC Light ® system consisting of converter stations near the Ingledew Substation in Surrey and the Pike Substation near Victoria, 51.0 kilometres of underground cable and 67.4 kilometres of submarine cable that bypasses the Gulf Islands; and C. Sea Breeze estimates that the VIC will cost $302 million, and that it can be in service by March 2008; and D. In the VIC Application, Sea Breeze requests that the Commission confirm the consolidation of its application with the proceeding that the Commission has established to review the British Columbia Transmission Corporation (“BCTC”) Vancouver Island Transmission Reinforcement (“VITR”) Application, and that the Commission establish a parallel regulatory timetable for the VIC Application; and . . ./2

In the letter dated August 9, 2005, that accompanied Order No. G-72-05, the Commission stated that participants will be given an opportunity to comment on any motion(s) filed by Sea Breeze, at the Pre-Hearing Conference in the VITR proceeding; and F. The Commission considers that submissions on the regulatory process for review of the VIC Application should be heard at the Pre-Hearing Conference for the VITR proceeding, as set out in the Revised Regulatory Timetable that is Appendix A to Order No. G-96-05. NOW THEREFORE the Commission orders as follows: 1. The Commission will hear submissions on the regulatory process for review of the VIC Application at the Friday, October 21, 2005 Pre-Hearing Conference for the BCTC VITR Application, that will commence at 9:00 a.m. on the 3 rd Floor, 855 Homer Street, Vancouver, B.C., to address procedural matters which will include, but may not be limited to the following: • whether the review of the VIC Application should be consolidated with the proceeding to review the BCTC VITR Application; • appropriate revisions, if any, to the regulatory timetable for review of the VITR; and • if the VIC Application is not consolidated with the proceeding to review the BCTC VITR Application: whether the review should proceed by an oral or written public hearing, or some other process; steps and timetable associated with the regulatory review process; and other matters that will assist the Commission to efficiently review the VIC Application. 2. After the Pre-Hearing Conference, the Commission will issue a further procedural Order and Regulatory Timetable that will address the review of the VIC Application.

Sea Breeze will publish, as soon as possible, in display-ad format, the Notice of Application and Pre-Hearing Conference attached as Appendix A to this Order, in the Vancouver Sun and Province, the Victoria Times Colonist, and such other appropriate local news publications as may properly provide adequate notice to the public in the affected service areas. 4. The VIC Application, together with any supporting materials, will be made available for inspection at the Sea Breeze Vancouver Office, and at the Commission’s office. 5. Intervenors and Interested Parties for the review of the VIC Application should register with the Commission, in writing, by Tuesday, October 18, 2005 and advise whether they will attend the Pre-Hearing Conference. Intervenors should specifically state the nature of their interest in the VIC Application and identify generally the nature of the issues that they intend to pursue during the review and the nature and extent of their anticipated involvement in the review process. 6. Information Request No. 1 will be provided to Sea Breeze by Monday, October 17, 2005 and Sea Breeze will respond to Information Request No. 1 by Monday, November 7, 2005.
