Hobbs, Chair April 5, 2005 O R D E R WHEREAS: A. On March 23, 2005, the British Columbia Transmission Corporation (“BCTC”) filed, pursuant to Sections 45(6) and 45(6.1) of the Utilities Commission Act, an Application (“the Application”) for approval of a Transmission System Capital Plan for the period F2006 to F2015 (F2006 and F2015 refer to BCTC’s Fiscal year ending March 31, 2006 and March 31, 2015 respectively) (“the 2005 Capital Plan”); and B. BCTC in the Application is seeking an order which states that this plan meets the requirements of Sections 45(6) and 45(6.1) of the Act, approves the 2005 Capital Plan under subsection 45(6.2) (a) and pursuant to Section 45(6.2) (b) approves all projects starting in F2006 and F2007 as listed in Section 7 of the Application; and C. BCTC filed its Transmission System Capital Plan relating to expenditures in F2005 on May 31, 2004 (“the 2004 Capital Plan”) and the Commission established a written hearing process to review it by Order No. G-63-04 and subsequently amended the process by Order No. G-73-04; and D. The Commission issued Order No. G-103-04 approving the filing of the 2004 Capital Plan for F2005 expenditures under Sections 45(6.1) and 45(6) and approving the expenditures for projects referred to in Section 5.2 of the 2004 Capital Plan as being in the public interest and ordering certain other directives; and E. BCTC responded to those directives in reports dated December 20 and 23, 2004; and F. BCTC recommends a written process for the review of its 2005 Capital Plan; and G. The Commission concludes that a written regulatory process should be established to deal with the 2005 Capital Plan Application. …/2

A written public hearing is established for the review of the BCTC 2005 Capital Plan Application. 2. BCTC will publish, as soon as possible in display ad format, the Notice of Written Public Hearing attached as Appendix A to this Order, in such appropriate news publications as may properly provide adequate notice to the public. 3. The Application and supporting material will be made available for inspection at the Head Office of BCTC at Suite 1100, Four Bentall Centre, 1055 Dunsmuir Street, Vancouver, B.C. and at the British Columbia Utilities Commission, Sixth Floor, 900 Howe Street, Vancouver, B.C. 4. Registered Intervenors and Interested Parties should inform the Commission in writing, by Friday, April 22 2005 of their intention to intervene and identify the nature of their interest in the Application. 5. The following Regulatory Agenda is established for the written public hearing: (a) Information Request No. 1 will be submitted to BCTC by Friday, April 29, 2005; (c) Responses to Information Request No. 1 will be completed by BCTC by Friday, May 20, 2005; (c) Information Request No. 2 will be submitted to BCTC by Friday June 3, 2005; (d) Responses to Information Request No. 2 will be completed by BCTC by Friday June 17, 2005; (c) Written submissions and comments may be made to the Commission with a copy to BCTC by Monday, June 27, 2005; and (d) BCTC may submit to the Commission a Final Response to those Submissions by Wednesday, July 13, 2005. The approvals requested by BCTC include confirmation that expenditures for certain projects contained in the 2005 Capital Plan are in the public interest. THE REGULATORY PROCESS The Commission will review the 2005 Capital Plan Application using a Written Public Hearing process according to a Regulatory Schedule established by Order No. G-33-05, available upon request or on the BCUC web site.
