Sustainable Energy Association and the Sierra Club of Canada (BC Chapter) (“BCSEA/SCBC”) for a participant cost award for its participation in the subject proceeding. Commission Letter No. L-85-05 dated October 11, 2005 set out the Commission Panels Reasons for Decision for denying the cost award. By Application dated October 13, 2005, BCSEA/SCBC seeks reconsideration of the Commissions decision in Order No. F-15-05, and a participant cost award in the amount requested in their July 29, 2005 application. On page 6 of their October 13, 2005 request for reconsideration, BCSEA/SCBC state that it is understood that British Columbia Hydro and Power Authority (“BC Hydro”) is the only respondent. The Commission hereby establishes a written comment process on the BCSEA/SCBC request, to address the first-phase question of whether a reasonable basis exists to allow a reconsideration. Following the completion of this written comment process, the Commission expects to decide whether or not a reconsideration should proceed. BC Hydro may submit written comments by Monday, October 31, 2005 with a copy to BCSEA/SCBC; and BCSEA/SCBC may submit a written reply to the BC Hydro comments by Monday, November 7, 2005. A copy of the Reconsideration and Appeals section of the Commissions Participant Guide, which identifies criteria that the Commission generally applies to determine whether a reasonable basis exists to allow a reconsideration, is enclosed. Comments from BC Hydro and BCSEA/SCBC should address whether the threshold for reconsideration has been met, rather than the substance of the issue. For a reconsideration hearing to proceed, the reconsideration applicant is required to meet the following criteria: .../2
LETTER NO. L-92-05 2 1. The claim of error appears to be substantiated on a prima facie basis; and 2. The error has significant material implications. If the Commission agrees to reconsider its decision, the parties will be allowed subsequently to address the substance of the issues that the Commission approves for reconsideration.
