LETTER NO. L-93-05 SIXTH FLOOR, 900 HOWE STREET, BOX 250 ROBERT J. PELLATT VANCOUVER, B.C. CANADA V6Z 2N3 COMMISSION SECRETARY TELEPHONE: (604) 660-4700 Commission.Secretary@bcuc.com BC TOLL FREE: 1-800-663-1385 web site: http://www.bcuc.com FACSIMILE: (604) 660-1102 VIA E-MAIL October 27, 2005 ICBC – 2006RR Exhibit A-11 TO: Insurance Corporation of British Columbia Registered Intervenors (ICBC-2006RR-RI) Re: Insurance Corporation of British Columbia (“ICBC”) Project No. 3698393 – Order No. G-78-05, Order No. G-85-05 and Order No. G-108-05 On October 25, 2005 the Commission received a letter from the Consumers’ Association of Canada (B.C. Branch) (“CACBC”), which is in response to Exhibit B-10 and ICBC’s filing of a “Confidential Response to Commission Information Request 43.3”. In their letter, CACBC requests that the British Columbia Utilities Commission either: i) direct the applicant to resubmit the filing as a public document; or ii) demonstrate the need for confidentiality in a submission available to all registered intervenors and interested parties. The Commission Panel has not reviewed Exhibit B-10 at this time and does not agree with the action requested by CACBC in alternative i) without first conducting a further examination of the issue. The Commission Panel hereby initiates a process that will further examine the issue and seek to determine whether or not the current confidential status of Exhibit B-10 requires to be preserved. The Commission Panel therefore directs ICBC to submit evidence which led ICBC to designate Exhibit B-10 as a confidential document. ICBC’s submission should be filed no later than the close of business on Monday, October 31, 2005. Registered Intervenors will then have an opportunity to submit a reply to ICBC’s submission by Wednesday, November 2, 2005. Thereafter, the Commission Panel will consider the submissions and make a determination with respect to the current confidential status of Exhibit B-10. Yours truly, Original signed by: Robert J.
