Kelsey, Commissioner May 18, 2006 O R D E R WHEREAS: A. The Commission, by Order No. G-59-00, approved for FortisBC Inc. (“FortisBC”) (formerly known as Aquila Networks Canada (British Columbia) Ltd. and West Kootenay Power Ltd.) and British Columbia Hydro and Power Authority (“B.C. Hydro”) a Letter Agreement between FortisBC and B.C. Hydro for Wholesale Transmission Service (“WTS”) from FortisBC’s South Slocan Generating Station to its Princeton, B.C. substation during off-peak hours during the period from May 20 to July 31, 2000. The Agreement provided for a renewal of the wheeling agreement terms between April 1 to July 31, 2001; and B. The Letter Agreement was subsequently extended in 2001, 2002, 2003, 2004 and 2005 by extensions that were approved by the Commission by Orders No. G-45-02, G-37-03, G-48-04 and G-49-05; and C. In 2005, British Columbia Transmission Corporation (“BCTC”) took over the B.C. Hydro electrical transmission system in the Province; and D. By letter dated May 5, 2006, BCTC agreed to FortisBC’s April 28, 2006 request to extend the WTS Agreement for wheeling power to Princeton, B.C. for the summer of 2006; and E. On May 12, 2006, FortisBC applied for Commission approval to extend the Letter Agreement to cover the period from May 9, 2006 to July 31, 2006; and . . ./2
2 F. The Commission has reviewed FortisBC’s May 12, 2006 Application and finds that it should be approved. NOW THEREFORE the Commission approves for FortisBC and BCTC an extension to the May 16, 2000 WTS Agreement for the transmission of power from FortisBC’s South Slocan Generating Station to its Princeton, B.C. substation during off-peak hours for the period May 9, 2006, to July 31, 2006.
