Kelsey, Commissioner L.A. Boychuk, Commissioner March 23, 2006 O R D E R WHEREAS: A. British Columbia Hydro and Power Authority (“BC Hydro”) filed on March 1, 2006, pursuant to sections 58, to 61 of the Utilities Commission Act (“the Act”), an application (“Application”) for approval of the Customer Baseline Load (“CBL”) for each customer account to be served under BC Hydro’s Stepped Rate, Rate Schedule (“RS”) 1823; and B. Customer Baseline Load Determination Guidelines (“CBL Guidelines”) were approved by Commission Orders No. G-79-05 and G-19-06; and C. In accordance with the BC Hydro’s Transmission Service Rate Application (“TSRA Application”) and Order No. G-79-05, which approved the TSRA Application subject to any modifications in the related Negotiated Settlement Agreement, the Stepped Rate is to come into effect on the first day of the customer billing period closest to April 1, 2006; and D. BC Hydro is still reviewing some customer’s requests for adjustments to their CBLs; and E. BC Hydro has stated that it will have completed those reviews and filed all the proposed CBLs by May 31, 2006, including those requiring additional review or verification; and F. BC Hydro in its Application has suggested a written process for dealing with disputes when BC Hydro and a customer disagree on the CBL proposed by BC Hydro; and G. BC Hydro has requested that the Commission approve, on an interim basis effective March 21, 2006, the CBLs in the column titled “CBL for Interim Approval” in Appendix B of the Application; and …/2
2 H. BC Hydro has further stated that, when the Commission has approved final CBLs, BC Hydro will make any necessary billing adjustments as contemplated in section 6.2.3 of the CBL Guidelines; and I. The Commission concludes that interim approval of the CBLs contained in Appendix B of the Application in the column titled “CBL for Interim Approval” is necessary and in the public interest. NOW THEREFORE the Commission orders as follows: 1. The Customer Baseline Loads in the column titled “CBL for Interim Approval” in Appendix B of the Application are approved on an interim basis, effective March 21, 2006. 2. BC Hydro is to have filed all CBLs, including those which require additional verification, by May 31, 2006. 3. The Commission will decide after May 31, 2006 on a process for dealing with disputes when BC Hydro and a customer disagree on the CBL proposed by BC Hydro. 4. Once the Commission has approved the final CBLs, BC Hydro is to make any necessary billing adjustments as set out in section 6.2.3 of the CBL Guidelines.
