Re: Terasen Gas Inc. (“Terasen Gas”)
Certificate of Public Convenience and Necessity
for the Residential Unbundling Program
On April 13, 2006, Terasen Gas applied to the Commission for a Certificate of Public Convenience and Necessity
pursuant to Section 45 of the Utilities Commission Act for the implementation of commodity unbundling for
residential customers (Exhibit B-1). In Letter No. L-17-06, the Commission set out the Revised Regulatory
Timetable which provided that Intervenor Request No. 1 was to be sent out May 19, 2006, Terasen Gas’ response
was to be submitted by June 2, 2006 and Intervenor evidence was to be filed by June 8, 2006.
The Oral Hearing took place on June 27, 2006 and you chose to not attend. At the hearing, the Panel Chair
admitted the evidence that you sought to have on the record by e-mail dated June 26, 2006 and marked as Exhibit
C2-6 (T2: 35, 88, 89). Your e-mail request dated June 27, 2006 and marked as Exhibit C2-8 to ask additional
Information Requests (T2: 36, 88) was denied. The evidentiary record of the proceeding was closed at 4:30 p.m.
on June 27, 2006 (T2: 277).
By e-mail dated June 28, 2006 you made a request to have further evidence posted to the Commission’s web
page. The Commission Secretary refused to post the material as the evidentiary record of the proceeding had
been closed prior to receipt of the material. By e-mail dated June 29, 2006 you asked that the matter be brought
to the attention of the Panel Chair and by further e-mail dated July 11, 2006 requested a ruling on the matter
providing no information as to why the material in the submission dated June 28, 2006 would be helpful or
necessary to the Commission’s deliberation in this matter, or an explanation as to why you were unable to submit
it in a timely fashion.
In fairness to other participants and in order to preserve the regulatory timetable for the proceeding, the
Commission Panel Chair denies your request that the submission filed on June 28, 2006 be admitted as evidence
in the proceeding.
