BEFORE: L.F. Kelsey, Commissioner June 15, 2006 O R D E R WHEREAS: A. On April 17, 2006 Silversmith Power and Light Corporation (“Silversmith”) applied for approval of an Electrical Service Application and draft changes to its Electric Tariff Terms and Conditions relating to service at Sandon, B.C. (the Application”); and B. The Electrical Service Application contains a proposed Electricity Supply Contract to serve customers residing at and holding a commercial tenure for the property known as the Tin Cup Café in Sandon, B.C. (the Contract”, the Customer”). The proposed Contract is to provide electric service in accordance with the Silversmith Electric Tariff and additional terms identified in the proposed Contract; and C. The additional terms in the proposed Contract are the required service, maximum demand, isolation of the Customers diesel generator from the Silversmith system, security deposit, connection fee and meter relocation; and D. The proposed Contract contains a connection fee of $200 instead of the $100 connection fee in the current Electric Tariff. The meter relocation fee to be recovered from the Customer in the proposed Contract is for the additional costs that Silversmith will incur to relocate the Customers meter to the nearest utility pole and the installation of a tamper-proof meter; and E. The draft changes to Silversmiths Electric Tariff Terms and Conditions of Service proposes additional clauses to be added and updated fees; and F. The Commission has reviewed the Application and is satisfied that approval of the proposed Contract, with required amendments, is warranted. …/2
2 NOW THEREFORE the Commission orders as follows: 1. The proposed Contract between Silversmith and the Customer is approved subject to these required amendments: (i) The Connection Charge is to be $100 in accordance with Section 4 of Silversmiths Electric Tariff. (ii) The Customer has not requested a meter relocation therefore the Contract is to require that the Customer provide Access to Premises in accordance with Section 7 of the Silversmith Electric Tariff. If the Customer does not provide Access to Premises in accordance with the Electric Tariff then Silversmith is allowed to relocate the meter to the nearest utility pole at a cost to the Customer not to exceed $325 representing the $225 Change of Meter Location fee in accordance with Section 14 of the Electric Tariff and the $100 Connection Charge. (iii) Silversmith is to provide electric service to the Customer immediately upon the Customer signing the amended Contract. 2. The Commission finds that the draft tariff changes to the Electric Tariff Terms and Conditions of Service are inconsistent with the Electric Tariff Terms and Conditions of Service of other utilities in British Columbia. Silversmith also has not provided its customers with a copy of its proposed tariff changes and updated fees; including the opportunity for comment, therefore the draft tariff changes are denied. 3. Silversmith is to provide a copy of this Order to its Customer.
