Kelsey, Commissioner October 26, 2006 O R D E R WHEREAS: A. On February 17, 2004 the Commission received an application from Pengrowth Corporation for an exemption from Section 71 and Part 3 of the Utilities Commission Act (“the Act”) for the purposes of the sale of power to L&E Consulting Ltd. B. Pengrowth Corporation owns and operates a diesel generator in an isolated area of Northeastern BC (LSD B-38-J/94-H-2) for the purposes of supplying power to its oil field operations; and C. Pursuant to Section 88(3) of the Act the Commission requested and received approval from the Lieutenant Governor in Council by Order in Council No. 687, 2004 to issue an exemption from Section 71 and Part 3 of the Act except for Section 22; and D. The Commission issued Order No. G-68-04 to Pengrowth Corporation for the Exemption from Part 3 and Section 71 of Act for the purposes of the sale and delivery of power to L&E Consulting Ltd.; and E. Orin Taves of Spirit Rentals has acquired the workers camp formerly owned and operated by L&E Consulting Ltd. and Cimmaron Camp Services operates the camp; and F. Pengrowth Corporation and Cimmaron Camp Services have entered a mutually acceptable agreement for the sale and delivery of power from Pengrowths diesel generation; and . . ./2
2 G. The Commission considers that the circumstances under which the original exemption Order was issued has not materially changed; and H. The Commission, pursuant to Section 99 of the Act, may reconsider, vary or rescind a decision, order, rule or regulation made by it. NOW THEREFORE the Commission orders that Order No. G-68-04 is varied to remove L&E Consulting Ltd. and to be replaced by Cimmaron Camp Services.
