Boychuk, Panel Chair and Commissioner October 16, 2006 O R D E R WHEREAS: A. On November 30, 2005, Pacific Northern Gas Ltd. (“PNG”, PNG-West”) applied to the Commission for approval of its 2006 Revenue Requirements (“the 2006 RR Application”) and to amend its rates on an interim and final basis, effective January 1, 2006, pursuant to Sections 89 and 58 of the Utilities Commission Act (“the Act”); and B. On November 30, 2005, Pacific Northern Gas (N.E.) Ltd. Fort St. John/Dawson Creek and Tumbler Ridge Divisions [“PNG (N.E.)”] filed for approval of its 2006 Revenue Requirements Application (“the Application”). PNG (N.E.) proposed to amend its rates on an interim and final basis, effective January 1, 2006, pursuant to Sections 89 and 58 of the Utilities Commission Act (“the Act”); and C. The Commission, by Order No. G-134-05, scheduled a Negotiated Settlement Process (“NSP”) for the PNG-West 2006 RR Application; and D. The Commission, by Order No. G-135-05, established an NSP for the review of the PNG (N.E.) Application. The Negotiated Settlement discussions were held in Vancouver on March 13, 14 and 15, 2006 and a proposed Settlement Agreement regarding the Application was agreed to by PNG (N.E.) and the Intervenors; and E. On August 16, 2006 the Commission, by Order No. G-99-06, approved for PNG-West the 2006 RR Application and issued its Reasons for Decision; and . . ./2
2 F. On August 16, 2006, the Commission issued Order No. G-100-06 approving the PNG (N.E.) Negotiated Settlement; and G. On August 18, 2006, the British Columbia Old Age Pensioners Organization et al (“BCOAPO”) applied for a Participant Assistance Cost Award (“PACA”) for its participation in the PNG-West and PNG (N.E.) Negotiated Settlement and 2006 Revenue Requirements proceedings; and H. Commission staff have advised the Panel that the BCOAPO participated in the PNG-West and PNG (N.E.) Negotiated Settlement and 2006 Revenue Requirements proceedings and contributed to the Commissions Decisions; and I. The Commission has reviewed the application for a cost award with regard to the criteria and rates set out in Order No. G-15-04. NOW THEREFORE the Commission orders as follows: 1. Pursuant to Section 118(1) of the Act, the Commission approves a PACA award $18,473.19 to the BCOAPO for its participation in the PNG-West and PNG (N.E.) Negotiated Settlement and 2006 Revenue Requirements proceedings. 2. PNG is directed to reimburse the BCOAPO for the total amount of $18,473.19 in a timely fashion.
