PELLATT COMMISSION SECRETARY Commission.Secretary@bcuc.com web site: http://www.bcuc.com VIA E-MAIL Ms. Christine Meerman Tin Cup Café christine@telus.net Dear Ms. Meerman and Mr. Wright: Re: Silversmith Power and Light Corporation (“Silversmith”) Service to Tin Cup Café By Order No. G-68-06 dated June 15, 2006, the Commission approved the form of contract for Silversmith to provide service to the Tin Cup Café. The Commission subsequently received an e-mail dated July 31, 2006 from Christine Meerman on behalf of the Tin Cup Café, and by letter dated August 2, 2006 requested a response from Silversmith. Silversmith responded by an e-mail dated August 4, 2006, and a further e-mail on the matter dated August 17, 2006 was received from Ms. Meerman. The Commission has considered the matter; and hereby directs Silversmith to expeditiously prepare a contract for service to the Tin Cup Café, and to forward the contract to the operator of the Tin Cup Café, with a copy to the Commission. Upon the operator of the Tin Cup Café executing the contract and paying the appropriate security deposit, Silversmith will immediately commence service to the Tin Cup Café. With respect to the appropriate amount of the security deposit for the Tin Cup Café, the Commission accepts Silversmiths estimate of an average monthly billing of $250.00 for similar commercial establishments, which under the terms of the Silversmith tariff indicates a security deposit of $750.00. Silversmith states that it is prepared to review the situation after one year, and to adjust the deposit accordingly. In her July 31, 2006 correspondence, Ms. Meerman also referred to $250.00 paid two years ago, but provided no details. In its August 4, 2006 e-mail, Silversmith did not respond to questions from the Commission to clarify the matter. Therefore, the Commission determines that the security deposit for the Tin Cup Café should be $750.00 less any amount of previous security deposit or equivalent that is currently held by Silversmith with respect to the Tin Cup Café. LETTER NO. L-46-06 2 If the amount of previous security deposit that is currently held by Silversmith is in dispute between the parties, Silversmith will provide service to the Tin Cup Café upon the payment of a security deposit of $750.00 and execution of the service contract. Silversmith and the Tin Cup Café will each file written statements of their position on the earlier security deposit, and supporting evidence, by Friday, September 15, 2006, with a copy to the other party. Each party may reply in writing to the other partys statement by Friday, September 22, 2006, and the Commission will then make a determination on the net amount of the security deposit.
