Kelsey, Commissioner L.A. Zaozirny, Commissioner November 16, 2006 O R D E R WHEREAS: A. Talisman Energy Canada (“Talisman”) as the operator and on behalf of itself and the other owners of Bullmoose Unit No. 1 has entered into an agreement for the purchase by Talisman from Bullmoose Operating Corporation (“BOC”) of the 240 kV to 25 kV Bullmoose Electrical Substation (“Bullmoose Substation”) located at d-77-E/93-P-3. The purchase is to close January 6, 2005; and B. Talisman intends to continue to use electrical power from the Bullmoose Substation for the Bullmoose Unit No. 1 compressor station, and is in discussions with British Columbia Hydro and Power Authority (“BC Hydro”) with respect to a Rate Schedule 1821 electricity supply contract; and C. Talisman intends to resell electrical power from the Bullmoose Substation to BOC for the reclamation of the BOC coal mine site at rates that are equivalent to BC Hydros Rate Schedule 1211; and D. Talisman also intends to resell electrical power from the Bullmoose Substation to Imperial Oil Limited for its compressor station located at b-93-L/93-P-3 at rates that are equivalent to BC Hydros Rate Schedule 1821 rate plus a fee to recover maintenance requirements; and E. Talisman states that it has received oral confirmation from BC Hydro that it has no objections to the two proposals to sell electrical power; and F. In a letter dated September 29, 2004 to the British Columbia Utilities Commission (the Commission”), Talisman applied for an exemption for the proposed power sales to BOC and Imperial Oil Limited from Part 3 and Section 71 of the Utilities Commission Act (the Act”); and G. The Commission has considered the application and is satisfied that an Order, under Section 88(3) of the Utilities Commission Act (the Act”) exempting the electrical power sales by Talisman to BOC and Imperial . . ./2
2 Oil Limited from the requirements under Section 71 and Part 3 (except Section 22), properly conserves the public interest; and H. On March 17, 2005, the approval of the Lieutenant Governor in Council was given to the said exemption by Order in Council No. 223, which is attached as Appendix A; and I. Section 99 of the Act provides that the Commission may reconsider, vary or rescind an Order made by it. NOW THEREFORE the Commission orders as follows: 1. Pursuant to Section 88(3) of the Act, the Commission approves an exemption for Talisman from Section 71 and Part 3 of the Act (except Section 22 of the Act) for the sales of electrical power from the Bullmoose Substation to BOC and Imperial Oil Limited, and an exemption for BOC and Imperial Oil Limited from Section 71 with respect to such sales. 2. The exemption will be effective the date of this Order. 3. Talisman is responsible for the safe and proper operation of its plant facilities consistent with the requirements of the Electrical Safety Branch.
