On December 10, 2004 by Order No. E-6-04 and on October 23, 2006 by Order No. E-6-06, the British Columbia Utilities Commission (the “Commission”), pursuant to Section 71 of the Utilities Commission Act (the “Act”) accepted for filing Contract No. 17971 between Anadarko Canada Corporation (“Anadarko”) and Terasen Gas Inc. (“Terasen Gas”), dated October 6, 2004; and B. On November 8, 2006, pursuant to Section 71 of the Act, Terasen Gas submitted an Assignment and Novation Agreement dated October 20, 2006 among Anadarko, Canadian Natural Resources Limited (“CNRL”) and Terasen Gas, whereby Anadarko assigned its interest in Contract No. 17971 to CNRL; and C. Also on November 8, 2006, pursuant to Section 71 of the Act, Terasen Gas submitted an Empress Extraction Agreement between Duke Energy Empress L.P. and Terasen Gas dated September 27, 2006 that is effective November 1, 2006; and D. On November 16, 2006, pursuant to Section 71 of the Act, Terasen Gas submitted a Cochrane Extraction Agreement between Cochrane/Empress V Partnership and Terasen Gas dated August 8, 2006 that is effective August 8, 2006; and F. The Commission has reviewed the Terasen Gas submissions and is satisfied that the Agreements are appropriate and should be accepted for filing. . . ./2
2 NOW THEREFORE pursuant to Section 71 of the Act and the Commission’s Rules for Natural Gas Energy Supply Contracts, the Commission orders as follows: 1. The Assignment and Novation Agreement among Anadarko, CNRL and Terasen Gas dated October 20, 2006 is accepted for filing. 2. The Empress Extraction Agreement between Duke Energy Empress L.P. and Terasen Gas dated September 27, 2006 is accepted for filing. 3. The Cochrane Extraction Agreement between Cochrane/Empress V Partnership and Terasen Gas dated August 8, 2006 is accepted for filing. 4. The Agreements referred to in sections 1, 2 and 3 of this Order will be held on a confidential basis.
