Velma Field, Bluesky Pool This letter addresses two matters that were raised at the November 1, 2006 Pre-Hearing Conference. First, Counsel for Canadian Natural Resources Ltd. raised questions about the jurisdiction of the British Columbia Utilities Commission (the “Commission”) to deal with the allocation of production from a gas pool in light of provisions in the Petroleum and Natural Gas Act, and whether the Commission needs to determine production allocation in order to avoid discrimination under the provisions of the Utilities Commission Act. The Commission expects that its jurisdiction to make a determination on production allocation and whether it needs to make such a determination should and will be addressed in the Hearing and in Argument, and will not make a decision on these matters at this time. Second, as requested by the parties at the Pre-Hearing Conference, the Commission confirms that it will not be making a determination on tariffs or fees that will apply for service provided by a Common Carrier or Common Processor, in its Decision at the conclusion of this proceeding. As established by Order No. G-93-06, the Oral Hearing will commence at 9:00 a.m. on Monday, November 6, 2006, in the Commission Hearing Room on the 12 th Floor, 1125 Howe Street, Vancouver, B.C.
