Keith Anderson, Commissioner September 29, 2006 O R D E R WHEREAS: A. On August 28, 2006, British Columbia Hydro and Power Authority (“BC Hydro”) filed an application (“Application”) pursuant to sections 58 to 61 of the Utilities Commission Act for approval of a set of residential time of use (“TOU”) rates to be offered under the Conservation Research Initiative (“CRI”) TOU Program on an optional basis; and B. The objectives of the CRI TOU Program are to learn about customer pricing preferences and response to pricing signals, to assess whether pricing can be used as a tool to delay future supply needs and infrastructure investments, and to provide an opportunity for BC Hydro to gain operational experience with advanced metering infrastructure; and C. By Letter No. L-48-06 the Commission determined that the Application would be reviewed by way of a workshop and negotiated settlement process (“NSP”) and, if agreement is not reached, by written submissions; and D. The workshop and settlement discussions were held on Tuesday, September 12, 2006; and E. By letter dated September 14, 2006, BC Hydro proposed certain amendments to its Application to address comments received from intervenors during the NSP; and F. By Letter No. L-55-06 the Commission amended the Regulatory Timetable to extend the deadline for intervenor submissions to September 18, 2006 while maintaining the original date of September 20, 2006 for BC Hydro final submissions; and . . ./2
2 G. Submissions were received on September 18, 2006 from the intervenors that participated in the NSP. All are generally supportive of BC Hydro’s Application as amended by its September 14, 2006 letter. Some intervenors expressed concerns about certain elements of the CRI TOU program design and the expected level of commitment by BC Hydro to working with the Advisory Committee, a proposed forum for stakeholders to provide advice and input into further development of the CRI TOU program; and H. On September 20, 2006 BC Hydro filed its submission in reply to intervenors, addressing the various concerns raised. NOW THEREFORE the Commission orders as follows: 1. The Commission approves BC Hydro’s Application as amended by its September 14, 2006 letter. 2. The Commission encourages BC Hydro to conduct meaningful consultation with stakeholders through the Advisory Committee and to incorporate the recommendations of the Advisory Committee, as appropriate, into any proposed redesign of CRI TOU rates for the second year of the two-year term of the program.
