The Commission understands that the CNRL letter dated November 17, 2006 and a letter also dated November 17, 2006 from counsel for Marauder Resources West Coast Inc. commenting on the CNRL letter have been copied to participants in the proceeding. The Argument phase of the proceeding is currently in progress, with Final Submissions by Intervenors to be filed by Thursday, November 23, 2006. Participants who wish to make submissions on CNRL’s leave application for its November 17, 2006 letter and on changes that should be made to the Regulatory Timetable in the event that the letter is accepted into evidence, are to do so in writing by 12:00 noon on Tuesday, November 21, 2006, with a copy to CNRL. CNRL will reply in writing to the submissions by noon on Wednesday, November 22, 2006. A copy of Mr. Harvey's correspondence is attached hereto. We respectfully submit that the information contained in the letter is relevant and should be considered by this Commission. The wells owned by CNRL and producing from the Velma Bluesky Pool have been shut-in as of November 17, 2006 in accordance with Mr. Harvey's letter. The information contained in this letter reflects the current situation regarding production from the Velrna Bluesky pool and is relevant information that should be considered by this Commission. We have also received Mr. Williams correspondence dated November 17, 2006 in response to Mr. Harvey's letter. We are somewhat dismayed and surprised by Marauder's position. hard to imagine how Marauder has been prejudiced by CNRL voluntarily shutting in the wells. In any event, if Marauder truly feels it has been prejudiced by Mr. Harvey's letter, Mr. Harvey can be presented for further cross examination or can answer questions by way of written interrogatories.
