Kelsey, Commissioner March 14, 2007 L.A. Zaozirny, Commissioner O R D E R WHEREAS: A. Terasen Gas Inc. (“TGI”) has been providing service to Weyerhaeuser Canada Ltd. (now referred to as Weyerhaeuser Company Limited, “Weyerhaeuser”) for its pulp mill and sawmill operations in Kamloops via a Rate Schedule 22A (“RS 22A”) Large Volume Transportation Agreement; and B. In the Commission’s October 25, 1993 Phase B Rate Design Decision, RS 22A was closed to new customers; and C. By Letter dated January 5, 2007, TGI was notified by Weyerhaeuser that the pulp mill operations at Kamloops would be sold and the RS 22A contract assigned to Domtar Pulp and Paper Products, Inc. (“Domtar”); and D. Weyerhaeuser will continue to own and operate the sawmill assets; and E. On March 6, 2007, TGI requested Commission approval to add the names of Domtar with respect to the pulp mill operation at Kamloops and Weyerhaeuser with respect to the sawmill operation at Kamloops, to the list of companies served under RS 22A (the “Application”). TGI submitted the request on the basis that the two mills are being served under RS 22A, the nature of the operations at the Kamloops site has not changed and the total annual consumption of the two mills is forecast to remain unchanged; and . . ./2
2 F. The Commission has considered the Application and concludes that it should be approved. NOW THEREFORE pursuant to Section 61 of the Utilities Commission Act, the Commission approves the addition of Domtar and Weyerhaeuser with regard to their respective pulp mill and sawmill operations in Kamloops, to the list of companies served under Terasen Gas’ RS 22A, effective March 5, 2007.
