(“FortisBC”) applied (the “Application”) to the British Columbia Utilities Commission (“Commission”) for a Certificate of Public Convenience and Necessity (“CPCN”) for the Ellison Substation Project (“the Project”); and B. By Order No. G-140-06 the Commission established an Oral Public Hearing process and Regulatory Timetable for the review of the Application; and C. By letter dated December 15, 2006, Counsel for the Quail Ridge Residents Association (“QRRA”) advised that he had just been retained by the QRRA and, citing a scheduling conflict and the potential benefit of “some form of additional public consultation” and an additional round of Information Requests, requested an adjournment of the Oral Public Hearing scheduled for January 9, 2007 (“QRRA Proposal”); and D. By letter dated December 19, 2006, Counsel for FortisBC responded to the QRRA Proposal consenting to a one-month adjournment of the Oral Public Hearing and proposed that the January 9, 2007 hearing date be utilized as a Pre-hearing Conference for the purpose of exchanging information and developing an issues list for the public hearing (“FortisBC Response”); and E. By letter dated December 20, 2006, Counsel for the QRRA provided further clarification to the QRRA Proposal; and F. By letter dated December 20, 2006, Mr. Hans Karow acknowledged the one month adjournment proposed by FortisBC, objected to it and suggested a four to five months adjournment to allow time for preparation; and G. The Commission Panel has considered the QRRA Proposal and the FortisBC Response and the submissions from Mr. Karow, and has determined that a short adjournment and an adjustment to the Regulatory Timetable set down in Order No. G-140-06 is warranted. NOW THEREFORE the Commission establishes a Revised Regulatory Timetable for the review of the Ellison Substation Project Application, attached as Appendix A. The Agenda for the Workshop and Pre-hearing Conference is attached as Appendix B. WORKSHOP 8:30 a.m. to 10:30 a.m. 1. Workshop for information exchange This portion of the Agenda will be chaired by Commission Staff and with the purpose of building understanding of the Application, will provide FortisBC an opportunity to explain the details of the Application followed by an opportunity for attendees to ask questions of FortisBC. Questions from attendees which seek to build a greater understanding of the Application will be permitted. The Commission Panel will not attend this session. B. PRE-HEARING CONFERENCE 10:45 a.m. to 12:00 noon 1:00 p.m. to 2:45 p.m. 2. Submissions from Intervenors and Interested Parties This portion of the Agenda will be before the Commission Panel and will provide an opportunity for Registered Intervenors and Interested Parties to make submissions on the Application. Parties wishing to make submissions will be required to pre-register with Commission Counsel by January 3, 2007. Further direction on the process for preregistration will be provided. Submissions will be limited to ten minutes and repeating subjects and information from previous submissions will be discouraged. 3. Development of Issues List 3:00 p.m. This portion of the Agenda will be before the Commission Panel and will hear submissions from FortisBC and Registered Intervenors on issues which parties consider should be pursued in the Oral Public Hearing, the scope of those issues and the sequence of agenda items. Submissions on the need for an additional round of Information Requests and the timing of steps following the Oral Public Hearing will also be heard.
