Hobbs, Chair July 11, 2007 O R D E R WHEREAS: A. In the Commissions June 20, 2005 Decision with respect to British Columbia Transmission Corporations (“BCTC”) Open Access Transmission Tariff (“OATT”), the Commission Panel directed BCTC to consult with British Columbia Hydro and Power Authority (“BC Hydro”) and to revise the OATT Terms and Conditions to give effect to several determinations and directions of the Commission Panel with respect to BCTCs transmission service and interconnection procedures for Competitive Electricity Acquisition Procedures (“CEAP”); and B. BCTC consulted with BC Hydro on the design of a tariff for CEAP and on June 8, 2007 applied to the Commission (“Application”) for acceptance and filing of a proposed Attachment P to the OATT that reflected agreement between BC Hydro and BCTC; and C. BCTC notes that Attachment P differs from the initial proposal during the OATT proceeding and the Commissions directives in one significant respect. The original proposal required the Network Customer to acquire and provide BCTC with information about prospective CEAP participants before submission of interconnection requests, requiring the Network Customer to assess and assemble potential portfolios of generators first, and to submit multiple NITS modifications, one for each portfolio. Attachment P provides for a single NITS modification in respect of successful CEAP Participants only, and still provides the 210 day limit on the queue freeze for other customers; and D. BCTC submits that this process protects the Network Customers queue position and results in a more efficient study process for the Transmission Provider, with no incremental impact on other interconnection and transmission customers; and E. Along with the new Attachment P, BCTC is also requesting amendments to the OATT Terms and Conditions, and to OATT Attachment M, to incorporate and make them consistent with Attachment P; and . . ./2

On June 8, 2007 BC Hydro filed a letter of support for the Application in which it states that, as the affected Network Customer, it is fully satisfied with the CEAP tariff filed and agrees that the Orders sought by BCTC should be granted; and G. The Commission has considered the BCTC Application and finds it in the public interest to approve the Application. NOW THEREFORE the Commission accepts for filing, effective July 1, 2007, Attachment P: Transmission Service and Interconnection Service Procedures for Competitive Acquisition Process and amendments to certain pages of the OATT and Attachment M of the OATT as filed in the Application.
