On September 5, 2007, British Columbia Hydro and Power Authority (“BC Hydro”) filed with the British Columbia Utilities Commission (the “Commission”) pursuant to Section 71 of the Utilities Commission Act (the “Act”) the 2007 Electricity Purchase Agreement (“2007 EPA”) between Alcan Inc. (“Alcan”) and BC Hydro dated August 13, 2007 that replaces existing agreements for the sale of electricity by Alcan to BC Hydro; and B. Under the 2007 EPA, Alcan will provide energy, capacity, shaping, scheduling and coordination services; and C. The term of the 2007 EPA is from October 1, 2007 to December 31, 2034. If the Commission does not accept the contract for filing by January 31, 2008, the parties’ obligations to each other under the 2007 EPA cease as of March 31, 2008; and D. The 2007 EPA is also filed pursuant to Section 61(1) of the Act in so far as it provides for BC Hydro to deliver energy to Alcan as part of coordination service arrangements; and E. BC Hydro held a public workshop on September 12, 2007 and, on September 21, 2007, submitted a Report (the “Report”) that describes the 2007 EPA; and F. On September 21, 2007, Alcan submitted the Alcan Report in support of the 2007 EPA and the Report; and G. By Order No. G-100-07, the Commission established a Procedural Conference for September 26, 2007; and . . ./2

The Commission has considered the submissions it received in writing prior to the September 26, 2007 Procedural Conference and the submissions made at the Procedural Conference and has determined that an Oral Public Hearing is required for the regulatory review of the 2007 EPA. NOW THEREFORE the Commission orders as follows: 1. A Procedural Conference regarding the scope of the proceeding for the review of the 2007 EPA will be held on Friday, October 5, 2007 commencing at 9:00 a.m. in the Commission Hearing Room on the Twelfth Floor, 1125 Howe Street, Vancouver, B.C. 2. An Oral Public Hearing into the 2007 EPA will commence on Monday, November 19, 2007 at 9:00 a.m. in the Commission Hearing Room on the Twelfth Floor, 1125 Howe Street, Vancouver, B.C., in accordance with the Regulatory Timetable for the proceeding that is attached as Appendix A to this Order.
