Kelsey, Commissioner A.W.K. Anderson, Commissioner June 14, 2007 O R D E R WHEREAS: A. By application dated May 8, 2007, Terasen Energy Marketing Inc. (“TEM”) applied for a Licence to Market Natural Gas (the “Application”); and B. TEM is a wholly owned, non-regulated subsidiary of Terasen Inc.; and C. By letter dated May 15, 2007, Direct Energy requested a review of the existing legislative instruments, including the Terasen Gas Inc. (“TGI”) Code of Conduct, in the event a natural gas marketer’s licence application is received from Terasen Inc. or an affiliate; and D. By letter dated December 3, 1997, the Commission approved and accepted for filing the Code of Conduct and Transfer Pricing Policy of BC Gas Utility Ltd. (now TGI); and E. The Commission has determined that a written public hearing is needed for the regulatory review of the Application, and that the hearing should consider whether the existing TGI Code of Conduct and Transfer Pricing Policy is satisfactory to address the situation that would be created if TEM is granted a licence to market natural gas. . . ./2
2 NOW THEREFORE the Commission orders as follows: 1. The Commission establishes a written public hearing for the review of the TEM Application, according to the Regulatory Timetable that is Appendix A to this Order. 2. In the hearing, the Commission will consider whether the existing TGI Code of Conduct and Transfer Pricing Policy is satisfactory to address the situation that would be created if TEM is granted a licence to market natural gas. 3. TEM is to provide a copy of this Order to all parties that have been granted a licence to market natural gas and to all Intervenors and Interested Parties in TGI’s 2006 Annual Review.
