Kelsey, Commissioner September 13, 2007 P.E. Vivian, Commissioner O R D E R WHEREAS: A. Terasen Gas (Vancouver Island) Inc. (“TGVI”) exercised its option with Terasen Gas Inc. (“Terasen Gas” or “TGI”) to maintain its existing capacity, deliverability and injection rights until May 31, 2011; and B. Commission Order No. E-15-07 dated July 23, 2007accepted the IGI Resources Inc. and Terasen Gas agreement dated March 19, 2007 that included a pricing amendment pursuant to Section 7a(e) of the agreement dated July 15, 2004; and C. Commission Order No. E-15-07 accepted the Amending Agreement between IGI Resources Inc. and Terasen Gas dated June 7, 2007, which was based on an amendment agreement dated September 15, 2005. The Amending Agreement accepted flow-through charges in TGI’s Mist Redelivery Agreement with IGI Resources Inc.; and D. On August 29, 2007 Terasen Gas filed with the Commission amendments to two storage and transportation agreements between TGI and TGVI with respect to the sublease of Mist Storage by TGVI from TGI and associated delivery to and redelivery from Mist Storage. Agreement No. 1 is the July 9, 2007 Amendment to the Agreement between TGI and TGVI with respect to Mist Storage dated June 14, 2004 called Agreement No. 1. The July 9, 2007 Amendment to the Mist Storage Agreement between TGI and TGVI Agreement dated October 25, 2005 called Agreement No. 2; and E. The Commission has reviewed the Terasen Gas filing and finds it to be consistent with the TGVI Annual Contracting Plan accepted by Commission Letter No. L-59-07. NOW THEREFORE pursuant to Section 71 of the Utilities Commission Act and the Commission’s Energy Supply Rules, the Commission accepts for filing the two amendments to the existing storage and transportation contracts described as follows: 1.
