Kelsey, Panel Chair and Commissioner June 28, 2007 O R D E R WHEREAS: A. On October 27, 2006 FortisBC Inc. (“FortisBC”) applied (the “Application”) to the British Columbia Utilities Commission (“Commission”) for a Certificate of Public Convenience and Necessity (“CPCN”) for the Ellison Substation Project (“the Project”); and B. Following a review of the Application that included an oral public hearing on April 2, 2007, the Commission by Order No. C-4-07 granted FortisBC a CPCN to construct the Ellison Project – Option l, directed FortisBC to file a report assessing the Airport site for the Substation as an alternative to the proposed Lochrem Road site, and determined that the Commission Panel would make a determination on a site for the Substation after reviewing the report and submissions on the report; and C. On June 6, 2007, FortisBC submitted its report assessing the Airport site, which concluded that the Airport site is inferior to the Lochrem Road site in multiple core areas. In addition, FortisBC stated that it has been advised by the City of Kelowna that the Airport site is not available for purchase; and D. On June 13, 2007, the Commission issued Reason for Decision as Appendix B of Order No. C-4-07; and . . ./2
2 E. The Commission received submissions on the report from Ms. Judy Clayton, the Concerned Citizen of Quail Ridge and Lochrem Road, and the Quail Ridge Residents Association. None of the submissions disputed FortisBC’s assessment of the Airport site in the report; and F. On June 20, 2007, FortisBC replied to the submissions; and G. The Commission Panel has considered the report assessing the Airport site filed by FortisBC and the submissions it has received, and has concluded that the Lochrem Road site is the more suitable site for the Substation. NOW THEREFORE the Commission orders that the Lochrem Road site is approved for FortisBC for the construction of the Ellison Substation, as applied for in the Application.
