In the 2007 Rate Design Application (“2007 RDA”) Phase I, British Columbia Hydro and Power Authority (“BC Hydro”) proposed, among other things, phasing out over a period of ten years ending April 1, 2018 a series of interruptible rates known as the E-Plus rates which includes Rate Schedules (“RS”) 1105, 1205, 1206 and 1207; and B. On October 26, 2007, the Commission issued its decision (“Decision”) on the BC Hydro 2007 RDA Phase I. The Decision, among other things, denied BC Hydro’s application to amend RS 1105, 1205, 1206 and 1207 as it was determined that BC Hydro had failed to meet the burden of proof in demonstrating that the E-Plus rates are no longer just and reasonable. The Commission also directed BC Hydro to file a report within 90 days to the Commission on the appropriateness to eliminate (a) Special Condition 4 of RS 1105; (b) RS 1205, 1206 and 1207; and (c) RS 1277 and RS 1278; and C. BC Hydro filed on January 24, 2008, in compliance with the Commission Directives 26, 27 and 28 and pursuant to Sections 58 to 60 of the Utilities Commission Act, a report and an application (“Application”) for amendments to RS 1105, 1205, 1206 and 1207 and the cancellation of RS 1277; and D. Specifically, BC Hydro applied for (i) approval to remove Special Condition 4 of RS 1105; (ii) approval to amend Special Condition 4 of RS 1205, 1206 and 1207 in order to provide for a one year period of notice of cancellation from April 1, 2008, rather than the thirty days currently stipulated; and (iii) approval to cancel RS 1277 effective April 1, 2008; and E. BC Hydro proposes in its Application to allow intervenors and interested parties in the 2007 RDA proceeding and General Service E-Plus customers an opportunity to make submissions by February 14, 2008, and if necessary allow a reply submission by BC Hydro by February 21, 2008; and F. The Commission Panel has reviewed the Application and the proposed process by BC Hydro. . . ./2

Intervenors, Interested Parties and all customers affected by the Application are to file written submissions to the Commission by Friday, February 15, 2008 on BC Hydro’s proposals in the Application and to comment on the availability of any new evidence supporting BC Hydro’s proposals. 2. BC Hydro is directed to file reply submissions by Friday, February 22, 2008.
