Kelsey, Panel Chair L.A. OHara, Commissioner A.A. Rhodes, Commissioner February 25, 2008 O R D E R WHEREAS: A. BC Hydro filed on February 20, 2008, pursuant to sections 58 to 61 of the Utilities Commission Act (“the Act”), its F2009 and F2010 Revenue Requirements application for, among other things, approval of across-the-board rate increases of 6.56 percent and 8.21 percent, effective April 1, 2008 and April 1, 2009, respectively, and approval of a reduction of the Deferral Account Rate Rider from 2.0 percent to 0.5 percent, effective April 1, 2008 (collectively, the F09/F10 RRA or Application”); and B. The Application also seeks refundable interim relief pursuant to sections 58 to 61 and section 90 of the Act to allow BC Hydro to increase its rates by 6.56 percent on an across-the-board basis, and to decrease its Deferral Account Rate Rider from 2.0 percent to 0.5 percent, both effective April 1, 2008, pending a full hearing into the F09/F10 RRA and orders subsequent to that hearing, on the basis that on April 1, 2008 BC Hydros current rates would otherwise no longer be fair, just, sufficient and not unduly discriminatory; and C. In its cover letter to the Application, BC Hydro attached a list of potential topics that BC Hydro would see arising out of the F09/F10 RRA. BC Hydro proposes that the Commission staff and Intervenors use the proposed Information Request (“IR”) topics as the basis for categorizing or tagging each IR question asked of BC Hydro. In BC Hydros proposed process Commission staff and Intervenors may also identify other topics not on BC Hydros proposed list and tag their IRs accordingly, in order to ensure a comprehensive categorization of all IRs and responses; and …/2

BC Hydro in its cover letter to the Application also addresses process issues in regard to its Rate Rebalancing Reconsideration Application, and interim relief sought in its Transmission Services Rate (“TSR”) Application and the F09/F10 RRA. BC Hydro proposes that the Commission establish one process to allow for submissions on a consolidated schedule that would enable the Commission to render orders on all these matters prior to March 14, 2008; and E. On February 22, 2008 the Commission issued Letter No. L-5-08 establishing the regulatory timetable for the Rate Rebalancing Reconsideration Application that included Intervenor Argument, BC Hydro Reply Argument, and Oral Phase of Argument (if required). The Letter also established the regulatory timetable for the TSR Application and F09/F10 RRA to address, by written submission, the BC Hydro request to implement interim rates effective April 1, 2008; and F. In its Application BC Hydro proposes a regulatory process to address its Residential Inclining Block (“RIB”) Rate Application (to be filed shortly), the TSR Application, and the F09/F10 RRA by proposing a preliminary process order that establishes an F09/F10 workshop, RIB Rate/TSR workshop, Commission Information Requests on the three applications, registration of Intervenors and Interested Parties, Intervenor IRs, BC Hydro responses to all IRs, and a Procedural Conference on or about Monday, April 28, 2008 to consider further process for all three applications, including consideration of which applications might be resolved through negotiated settlement or written process; and G. The Commission has reviewed BC Hydros proposed regulatory timetable and considers that a Procedural Conference is required to hear submissions on the regulatory process for the review of the RIB Rate Application, the TSR Application, and the F09/F10 RRA. NOW THEREFORE the Commission orders as follows: 1. BC Hydro is to hold a Workshop with respect to the F09/F10 RRA on Thursday, March 6, 2008, commencing at 9:00 a.m., in the Commissions Hearing Room on the 12 th Floor, 1125 Howe Street, Vancouver, B.C. 2. A Procedural Conference regarding the regulatory process for the review of the RIB Rate Application, TSR Application, and F09/F10 RRA will held on Monday, April 28, 2008, commencing at 9:00 a.m., in the Commissions Hearing Room on the 12 th Floor, 1125 Howe Street, Vancouver, B.C. 3. After the Procedural Conference, the Commission will issue a further procedural Order and Regulatory Timetable for the review of the F09/F10 RRA. 4. The deadlines for Commission and Intervenor Information Requests No. 1 to BC Hydro, and the responses from BC Hydro are set out in the Regulatory Timetable attached as Appendix A to this Order. 5. BC Hydro is to provide a copy of this Commission Order and the Regulatory Timetable attached as Appendix A to this Order to all parties who participated in the F07/F08 Revenue Requirements Application and the 2007 Rate Design Application. …/3

The F09/F10 RRA with any supporting materials, will be made available for inspection at the BC Hydro Head Office in Vancouver and BC Hydro offices in Burnaby, Fort St. John, Kamloops, Surrey, Nanaimo, North Vancouver, Prince George, Salmon Arm, Vernon, and Victoria. The materials will also be available on BC Hydros website at http://www.bchydro.com and on the Commissions website at http://www.bcuc.com. 7. Intervenors and Interested Parties should register for the F09/F10 RRA with the Commission, in writing or by online web registration, by Thursday, March 20, 2008 and advise whether they will attend the Procedural Conference. Intervenors should specifically state the nature of their interest in the F09/F10 RRA and identify generally the nature of the issues that they intend to pursue during the F09/F10 RRA proceeding and the nature and extent of their anticipated involvement in the review process or processes. 8. Intervenors intending to apply for participant assistance must submit a budget estimate by Monday, May 12, 2008, consistent with the Commissions Participant Assistance/Cost Award Guidelines and Order No. G-72-07. Copies are available upon request or can be downloaded from the Commissions web site at http://www.bcuc.com. The F09/F10 RRA Workshop will be eligible for funding as a proceeding day. 9. Information Requests to BC Hydro should be categorized or tagged using BC Hydros proposed Information Request Topic List, as indicated following the cover letter of the Application. The Commission staff and Intervenors may also identify other topics not on BC Hydros proposed list and tag their Information Requests accordingly.
