Pullman, Panel Chair R.J. Milbourne, Commissioner November 27, 2007 L.A. O’Hara, Commissioner O R D E R WHEREAS: A. BC Hydro filed on October 1, 2007 the Zone II Special Contract Rate Application (“Application”) as Phase III of the 2007 RDA, pursuant to Commission Orders No. G-84-07 and No. G-97-07; and B. By Order No. G-122-07 dated October 5, 2007, the Commission established a Preliminary Regulatory Timetable that sets out dates for Commission and Intervenor Information Requests (“IRs”) and allows for written submission on the procedure for reviewing the Application; and C. By letters dated November 23, 2007 and November 25, 2007, the Central Coast Power Corporation (“CCPC”) submits that an oral hearing of approximately three days is the most appropriate process. CCPC also advises the Commission of its non-availability during the period January 8 to January 21, 2007; and D. By letter dated November 23, 2007, the Heiltsuk Tribal Council and Shearwater Marine Limited (“Heiltsuk/Shearwater”) submit that an oral hearing would be the most appropriate process to review the Application and advise the Commission that they are not preparing to file evidence or present a Heiltsuk/Shearwater witness panel provided that the Heiltsuk/Shearwater evidence in Phase II forms part of the record in the Phase III proceeding; and E. By letter dated November 23, 2007, BC Hydro proposes a written process for the review of the Application in light of the fact that only three parties have registered as Intervenors and out of the three, only two have filed IRs. BC Hydro proposes a written submission by Intervenors and a reply submission from BC Hydro without the need to file a formal argument as a first step in the process; and …/2

The Commission has reviewed the submissions from CCPC, Heiltsuk/Shearwater and BC Hydro, notes that no other registered intervenors submitted comments regarding the review process or timetable, and considers that a written hearing for the review of the Application is appropriate. NOW THEREFORE the Commission orders as follows: 1. A Written Public Hearing process is established for the regulatory review of the Zone II Special Contract Rate Application, according to the Regulatory Timetable that is Appendix A to this Order. 2. The Evidence filed in Phase II of the 2007 RDA forms part of the record in the Phase III proceeding.
