(“Plateau”, the “Company”) Application for the Approval of 2007 and 2008 Western System Tolls (the “Application”) On March 7, 2008 Husky Oil Operations Limited (“Husky”) informed the Commission that it had reached an Agreement in Principle with Plateau regarding the tolls on the Western System for deliveries to Husky’s Prince George refinery. The letter also stated that upon completion of a settlement agreement (the “Settlement Agreement”), it would be placed before the Commission for approval. Commission Letter No. L-7-08 requested that Plateau and Husky expedite the development and review of the tolls for deliveries to Husky’s Prince George refinery. The letter also stated that any parties’ submissions to the Commission regarding additional regulatory process would be due two weeks following the filing date of the Settlement Agreement. On March 28, 2008 Plateau requested Commission approval of the Settlement Agreement between the Company and Husky. The Settlement Agreement only applies to tolls for deliveries to Husky’s Prince George refinery and does not apply to tolls for deliveries to Kamloops. Having regard to the impact of the Settlement Agreement upon the Application, Plateau has amended the Application and proposed the Regulatory Agenda and Timetable (the “Proposed Regulatory Timetable”) set out in Appendix A to this Letter. In accordance with Commission Letter No. L-7-08, Commission requests submissions regarding additional regulatory processes by April 11, 2008 (the “Submissions Deadline”). Please note that the April 9, 2008 deadline for Commission Information Request No. 3 and Intervenor Information Requests in Proposed Regulatory Timetable conflicts with the Submissions Deadline. If approved, the dates in the Proposed Regulatory Timetable could be extended by one week or more to allow time for the Commission to issue an order or letter following the Submissions Deadline.
