Jeffrey 2007 TOLLS FOR THE WESTERN SYSTEM EXHIBIT A-9 Blake, Cassels & Graydon 855 – 2 nd Street SW Calgary, Alberta T2P 4JB Dear Mr. Jeffrey: Re: Plateau Pipe Line Ltd. (“Plateau”, “the Company”) Application for the Approval of 2007 and 2008 Western System Tolls On March 7, 2008 Husky Oil Operations Limited (“Husky”) informed the Commission that it has reached an Agreement in Principle with Plateau (the “Agreement in Principle”) regarding the tolls on the Western System for deliveries at Husky’s Prince George refinery. The letter also states that Plateau is presently working on drafting a settlement agreement for Husky’s review, and upon completion of a settlement agreement (the “Settlement Agreement”), it will be placed before the Commission for approval. On March 10, 2008, Chevron Canada Limited (“Chevron”) advised the Commission that it did not participate in the negotiations, which preceded the Agreement in Principle and at this point, Chevron is unaware of the substance of the Settlement Agreement that is being drafted. Chevron requests that the Commission suspend the remaining dates in the Amended Regulatory Agenda and Timetable. In a letter dated March 13, 2008, Plateau confirmed the Agreement in Principle and estimates that it will place the Settlement Agreement before the Commission for approval within 30 days. With respect to Chevron’s March 10, 2008 letter, Plateau states that this Settlement Agreement only applies to tolls for deliveries to Husky’s Prince George refinery and it does not apply to the tolls for deliveries to Kamloops. In view of the preceding developments, the Commission hereby suspends the remaining dates in the Amended Regulatory Agenda and Timetable, including the deadline for Intervenor Evidence scheduled for March 12, 2008. The Commission requests Plateau and Husky to expedite the development, review and completion of the Agreement in Principle and to place it before the Commission at the earliest possible time. The Commission requests thereafter that any parties’ submissions to the Commission regarding additional regulatory process will be due two weeks following the filing date of the Agreement in Principle.
