Pullman, Panel Chair R.J. Milbourne, Commissioner February 6, 2008 L.A. OHara, Commissioner O R D E R WHEREAS: A. On March 15, 2007, BC Hydro filed, in compliance with Commission Order No. G-148-06, its 2007 RDA which addressed rate rebalancing, rate restructuring, changes to the E-Plus rates, amendments to terms and conditions and the distribution extension policy. On May 8, 2007, the Commission established an Oral Public Hearing process for the review of the Application by Order No. G-50-07; and B. The Oral Public Hearing commenced on July 9, 2007 in Vancouver. On July 17, 2007, the Commission Panel made the determination that the Application would be heard in three phases. Phase I would cover the issues related to Items No. 1 to 5 on the Issues List; Phase II would cover issues in Items No. 6 and 7 of the Issues List; and Phase III would cover the BC Hydro Special Contract rates; and C. On October 1, 2007, pursuant to Commission Orders No. G-84-07 and No. G-97-07 and Sections 58 to 61 of the Act, BC Hydro filed an application (“Phase III Application”) to address all issues related to Zone II Special Contract rates, including Special Contracts for Independent Power Producers in Zone II; and D. By Commission Order No. G-122-07, the Commission established a Preliminary Regulatory Timetable for the review of the Phase III Application including Information Requests (“IRs”) by November 2, 2007 and responses to IRs on November 19, 2007; and E. By Order No. G-142-07 dated November 27, 2007, the Commission established a Written Public Hearing for the review of the Phase III Application; and F. By Order No. G-171-07 and attached Reasons for Decision dated December 21, 2007, the Commission rendered its decision on the relief sought by BC Hydro in the Phase III Application; and G. On January 17, 2008, the Heiltsuk Tribal Council and Shearwater Marine Ltd. (“Heiltsuk/Shearwater”) applied for a PACA for their participation in Phase III of the proceeding; and . . ./2
2 H. By letter dated January 31, 2008 to the Commission, BC Hydro advised that it had no comments regarding the PACA request; and I. The Commission has reviewed the PACA application with regard to the criteria and rates set out in the Guidelines in Commission Order No. G-72-07 and has determined that the requested funding of $8,667.00 should be approved for the Heiltsuk/Shearwater. NOW THEREFORE pursuant to Section 118(1) of the Act, the Commission awards $8,667.00 of legal fees and PST on fees to the Heiltsuk/Shearwater for their participation in the proceeding.
