Kelsey, Commissioner P.E. Vivian, Commissioner O R D E R WHEREAS: A. On April 9, 2008 pursuant to Section 71 of the Utilities Commission Act (“Act”), FortisBC Inc. (“FortisBC”) filed with the Commission certain Electricity Purchase Agreements (“EPAs”). The EPAs are listed in Appendix A to this Order and are more specifically identified in the Application; and B. In the Application, FortisBC requested that the Commission keep the EPAs and Application confidential; and C. The Commission has reviewed the EPAs related to these Agreements; and D. The Commission has considered the Application. NOW THEREFORE pursuant to Section 71 of the Act, the Commission orders as follows: 1. The EPAs that are set out in Appendix A to this Order are accepted for filing as amendments to Energy Supply Contracts. 2. The Commission will keep confidential the EPAs and Schedule A of the Application.
