Pursuant to Section 71 of the Utilities Commission Act (the “Act”) on April 28, 2008 British Columbia Hydro and Power Authority (“BC Hydro”) filed with the Commission certain agreements (the “Amending Agreements”) that amend Electricity Purchase Agreements and which BC Hydro processed during the period ending March 31, 2008 (the “Application”). The Amending Agreements are listed in Appendix A to this Order and are more specifically identified in Schedule A (“Schedule A”) of the Application; and B. The Commission acknowledges receipt of the two documents, which BC Hydro included in the same filing, that set out contractual developments related to Electricity Purchase Agreements that BC Hydro considers are not amendments to the agreements, and which are listed in Appendix B to this Order; and C. The Commission has considered the Application, and has determined that it is in the public interest. NOW THEREFORE the Commission orders that the Amending Agreements that are set out in Appendix A to this Order are accepted for filing as amendments to Energy Purchase Agreements, pursuant to Section 71 of the Act.
