Kelsey, Commissioner P.E. Vivian, Commissioner April 10, 2008 O R D E R WHEREAS: A. By Order No. G-26-07 dated March 15, 2007, the Commission approved for Terasen Gas Inc. (“Terasen Gas”) an agreement dated January 1, 2007 with Elk Valley Coal Corporation (“Elk Valley Coal”) for its Line Creek Operations as Rate Schedule 22B Tariff Supplement (“TS”) No. G-19; and B. TS No. G-19 provides a reduced interruptible rate for the summer period from April 1 through October 31, and during the winter period of November 1 through March 31 for interruptible volumes delivered in excess of 10 percent of the contracted Daily Transmission Quantity (“DTQ”) times the number of days in the month. Elk Valley Coal agrees that it will not decrease its DTQ at the mine site during the term of the Tariff Supplement; and C. The interruptible rate in TS No. G-19 is adjusted annually based on Rate Schedule 22B rates, and the Tariff Supplement will continue in effect from year to year unless terminated by notice from either party; and D. By letter dated March 27, 2008, Terasen Gas requested Commission approval of three Rate Schedule 22B Tariff Supplement Agreements with Elk Valley Coal; TS No. G-13 for Elkview Operations, TS No. G-14 for Fording River Operations and TS No. G-15 for Greenhills Operations (the “Application”); and . . . /2
2 E. TS No. 13, 14 and 15 have an effective date of April 1, 2008, and otherwise have terms that are similar to those of TS No. G-19 for Line Creek Operations; and F. The Commission has reviewed the Application and finds that it should be approved. NOW THEREFORE the Commission approves for Terasen Gas the Rate Schedule 22B Transportation Service Agreements dated April 1, 2008 with Elk Valley Coal for its Elkview Operations, Fording River Operations and Greenhills Operations as TS No. 13, 14 and 15 respectively, effective April 1, 2008.
