Energy Efficiency and Conservation Programs Application BEFORE: A.W.K. Anderson, Commissioner June 19, 2008 A.A. Rhodes, Commissioner O R D E R WHEREAS: A. On May 28, 2008 Terasen Gas Inc. (“Terasen”, “TGI”) and Terasen Gas (Vancouver Island) Inc. (“TGVI”) (collectively “Terasen” or “the Companies”) jointly filed an Energy Efficiency and Conservation Application (“Application”) for approval of increased expenditures in support of an expanded Energy Efficiency and Conservation (“EEC”) strategy, and to capitalize incremental EEC expenditures by charging the expenditures to a regulatory asset deferral account and amortizing the balance over 20 years; and B. In the Application the Companies proposed a regulatory timetable culminating in a Commission decision on or before August 15, 2008; and C. On June 3, 2008 the Commission issued a letter requesting that interested parties register as Intervenors and file comments on Terasen’s proposed timetable by June 11, 2008; and D. British Columbia Hydro and Power Authority (“BC Hydro”), British Columbia Old Age Pensioners Organization et. al. (“BCOAPO”), and the B.C. Sustainable Energy Association and the Sierra Club of Canada [British Columbia Chapter] (collectively “BCSEA”) responded by June 11, 2008, and all three submitted that the Companies’ suggested timetable was unacceptably compressed; and E. The Commercial Energy Consumers Association of British Columbia (“CEC”) filed a letter of response on June 18, 2008, and submitted that the process and timetable proposed by Terasen was acceptable to the CEC; and F. The Commission has considered Terasen’s proposed regulatory timetable for the review process for the Application and the submissions of Intervenors and considers that an Order to establish a Preliminary Regulatory Timetable is required. …/2
2 NOW THEREFORE the Commission orders as follows: 1. The first steps in the regulatory review process will be in accordance with the Preliminary Regulatory Timetable that is attached as Appendix A to this Order. 2. Further steps in the regulatory review process will be established following written submissions on the process for the further review of the Application including, but not limited to, issues such as: The need for another round of Information Requests and Responses; The intention of Intervenors to present evidence; and The type of process for further review of the Application (Written or Oral Hearing or Negotiated Settlement Process). 3. The Companies and Intervenors are requested to provide their submissions on further process by Wednesday, August 27, 2008.
