Vivian, Commissioner A.A. Rhodes, Commissioner O R D E R WHEREAS: A. On September 26, 2008, Big White Gas Utility Ltd. (“BWGU”) filed a confidential letter to the British Columbia Utilities Commission (the “Commission”) containing its Financial Forecast for June 1, 2008 to May 31, 2009 (“the Filing”); and B. On May 29, 2008 the Commission issued Letter L‐22‐08 that stated the Commission plans to direct BWGU to file by no later than April 30, 2009, its 2009 Revenue Requirements (June 1, 2009 to May 31, 2010) (“2009 RRA”); and C. Subsequently, on June 19, 2008 the Commission issued Order G‐98‐08 with Directive No. 4 that BWGU was to file by September 30, 2008 a financial forecast for the June 1, 2008 to May 31, 2009 fiscal year that demonstrates that its current rates are reasonable so that a filing of a 2008 Revenue Requirements Application (“2008 RRA”) would not be required; and D. The Commission has reviewed BWGU’s Filing and finds that it satisfies Directive No. 4 in Order G‐98‐08, the current rates are in the public interest, and BWGU should continue to operate under its existing tariff without filing a 2008 Revenue Requirements Application. NOW THEREFORE pursuant to Sections 24 and 59 of the Utilities Commission Act, the Commission directs BWGU to file by April 30, 2009 a financial forecast for the June 1, 2009 to May 31, 2010 fiscal year that demonstrates that its current rates are not unreasonable so that a filing of a 2009 Revenue Requirements Application would not be required.
