Kelsey, Commissioner September 22, 2008 O R D E R WHEREAS: A. On September 19, 2008 Terasen Gas Inc. (“Terasen Gas”) applied to the Commission for approval of the 2008/09 Gas Supply Mitigation Incentive Program (“GSMIP”), (the “Application”). The proposed 2008/09 GSMIP plan remains fundamentally unchanged from the 2007/08 GSMIP plan that was approved by the Commission pursuant to Order G‐85‐07; and B. The objective of the GSMIP plan is to align the interests of the customers and shareholders to effectively manage mitigation activities to offset customers’ midstream costs; and C. Terasen Gas has had a form of GSMIP in place since 1995 when the Commission first approved a two year Off‐System Incentive Program (“OSIP”) pursuant to Order G‐98‐95. The current form of the GSMIP has been fundamentally maintained since 2002 consistent with the revenue requirements and the negotiated settlement agreement that was approved by Commission Order G‐79‐02, dated October 31, 2002. Since then, the GSMIP program that was agreed to in 2002 has been substantially renewed for subsequent years with stakeholder support; and D. The Commission requires a written hearing regulatory process to deal with the Application. …/2
2 NOW THEREFORE the Commission orders as follows: 1. A written hearing process is established to examine the information submitted in the Application. 2. Terasen Gas is to send out a copy of the Order and Application to those registered intervenors who participated in the 2007 Annual Review. The Regulatory Timetable is set out in Appendix A attached to this Order.
