Milbourne, Commissioner O R D E R WHEREAS: A. British Columbia Hydro and Power Authority (“BC Hydro”) filed on March 17, 2006, pursuant to sections 58 to 61 of the Utilities Commission Act (“the Act”), an application for approval of the Customer Baseline Load (“CBL”) for each customer account to be served under BC Hydro’s Stepped Rate, Rate Schedule (“RS”) 1823; and B. Customer Baseline Load Determination Guidelines (“CBL Guidelines”) were approved by Commission Orders G‐79‐05 and G‐19‐06, and those Guidelines establish a process for periodic revisions to a customer’s CBL; and C. Pursuant to Commission Letter L‐63‐06, BC Hydro filed the CBL Guidelines with the Commission as Electric Tariff Supplement No. 74 (“TS 74”); and D. By Order G‐138‐06 dated November 8, 2006, the Commission approved final CBLs for each RS 1823 customer; and E. Pursuant to Letter L‐69‐06 dated November 7, 2006, and issued concurrently with Order G‐138‐06, the Commission sought comments on issues concerning BC Hydro’s CBL Adjustment Tariff Practices (“Tariff Practices”); and F. In response to Letter L‐69‐06, the Commission received submissions from the Joint Industry Electricity Steering Committee (“JIESC”) and Highland Valley Copper on November 17, 2006. By Order G‐156‐06 dated December 7, 2006, the Commission approved the CBL Adjustment Tariff Practices filed by BC Hydro in its November 24, 2006 submissions, as revised by the Order, and indicated that the Tariff Practices would be appropriate for the purpose of providing guidance to the parties in applying the CBL Guidelines in respect of future CBL adjustment requests, but only where the CBL Guidelines are silent and never when inconsistent with the CBL Guidelines; and H. By Application dated November 14, 2008 (“Application”), BC Hydro seeks approval of revised F2008 and new F2009 CBLs (shown in Appendix A of the Application in the columns titled “Adjusted F2008 CBL (366 days)” and “F2009 CBL For Approval”) for BC Hydro customer accounts served on RS 1823; and I. BC Hydro stated that there were a total of 130 unique customer sites that were served at transmission voltage in F2008 and 122 of these sites are reflected in this filing. BC Hydro stated that it expected to file the remaining eight customer CBLs separately by the end of November 2008 as those CBLs were still under development or review with the customer; and J. Since the CBLs are required for billing purposes, BC Hydro requested an order from the Commission pursuant to sections 89 and 90 of the Act approving, on an interim basis, the F2009 CBLs effective April 1,2008; and K. The Application also seeks Commission approval pursuant to section 26(a) of the Act, of several new and revised CBL adjustment tariff practices that arose during the development of the F2009 CBLs; and L. BC Hydro stated that per section 6.2.1 of Tariff Supplement No. 74 (“TS No. 74”) the CBL Determination Guidelines, BC Hydro has submitted all F2009 CBL determinations, and any required adjustments to the F2008 CBLs, to the customer for review and comment prior to this filing; and M. BC Hydro filed seven of the remaining eight customer CBLs on December 22, 2008 (“December 22 Filing”), and stated in the December 22 Filing that it will file the one remaining CBL separately in early 2009 as the technical review of the CBL adjustment is complex and is still being resolved. NOW THEREFORE the Commission orders as follows: 1. The F2009 CBLs in the Application and the December 22 Filing (shown in Appendix A in the column titled “F2009 CBL For Approval”) for BC Hydro customer accounts served on RS 1823 are approved on an interim basis effective April 1, 2008. …/3

Pursuant to Letter L‐64‐08 issued concurrently with this Order, the Commission requests that those Rate Schedule 1823 customers with new or revised CBLs, except for the one customer that has yet to receive its new or revised CBL, advise the Commission in writing by January 30, 2009 if they wish to dispute the CBLs that BC Hydro has proposed for them. The customer that has yet to receive its new or revised CBL is to similarly respond within thirty days of receiving its new or revised CBL from BC Hydro. In the event that any customer does not so advise the Commission by the date stipulated for it, the Commission will conclude that the customer agrees with the CBLs proposed by BC Hydro. 3. BC Hydro is directed to provide a copy of this Order and Letter L‐64‐08 to all RS 1823 customers by January 12, 2009. 4. All RS 1823 customers are requested to provide any comments on BC Hydro’s proposed new and revised CBL adjustment tariff practices, also by January 30, 2009. 5. If there are disputes pursuant to items 2 and 4 above, the Commission will establish a process to review the disputes. 6. Once the Commission has approved the final CBLs, BC Hydro is to make any necessary billing adjustments as set out in section 6.2.3 of Tariff Supplement No. 74.
