Application for a Net Metering Rate Rate Schedule 95 BEFORE: P.E. Vivian, Commissioner and Panel Chair A.A. Rhodes, Commissioner O R D E R WHEREAS: A. On April 17, 2009, FortisBC Inc. (“FortisBC”) applied to the Commission for approval of Rate Schedule 95 – Net Metering (“the Application”); and B. FortisBC developed and prepared the Application to support the policy goals of energy self‐sufficiency and clean electricity generation as identified in the provincial 2007 Energy Plan, at the request of interested parties, and in response to Commission Order G‐115‐07. The Net Metering program applied for in the Application was developed based on the guidelines the Commission provided to British Columbia Hydro and Power Authority in Letter L‐37‐03 dated July 22, 2003; and C. The Commission considers that a written hearing is required for the regulatory review of the Application. NOW THEREFORE pursuant to sections 60 and 61 of the Utilities Commission Act, the Commission orders as follows: 1. A written public hearing process be established according to the Regulatory Timetable attached as Appendix A to this Order. 2. FortisBC shall publish, as soon as possible, in display‐ad format, the Notice of Application and Written Public Hearing Process, attached as Appendix B, in sufficient newspapers in the FortisBC service area to adequately inform the public of the Application. The notice should also be posted on FortisBC website and copies be provided to all stakeholders who participated in the FortisBC 2009 Revenue Requirements Application, the FortisBC 2009‐2010 Capital Expansion Plan, and the BC Hydro Net Metering Re‐pricing Application.
