Cote, Commissioner O R D E R WHEREAS: A. On September 21, 2007, the British Columbia Utilities Commission (the “Commission”) issued Order G‐115‐07 directing FortisBC Inc. (“FortisBC”, “the Company”) to file a Cost of Service (“COS”) study by June 30, 2008 and a Rate Design Application (“RDA”) by September 1, 2008; and B. By letter dated April 7, 2008 FortisBC applied to the Commission to extend those filing dates by six months; and C. Commission Order G‐83‐08 extended the filing deadlines to September 30, 2008 for the COS study, and to December 31, 2008 for the RDA; and D. By letter dated September 16, 2008 FortisBC stated that, due to developments unforeseen at the time of Order G‐183‐ 08, including settlement of FortisBC’s 2009 Revenue Requirements and Performance Based Regulation (“PBR”) for 2009 to 2011, further delaying the filings would be prudent. FortisBC proposed filing dates of December 31, 2008 for the COS study, and February 20, 2009 for the RDA; and E. On September 26, 2008, the Commission issued Order G‐147‐08 directing FortisBC to file the COS study by December 31, 2008 and to file the RDA by February 20, 2009; and F. On November 10, 2008, the Commission issued Order G‐164‐08 directing FortisBC to file the COS study by June 30, 2009 and to file the RDA by September 30, 2009; and H. By letter dated September 28, 2009, FortisBC advised the Commission that it is currently engaged in discussions with the British Columbia Municipal Electric Utilities (“BCMEU”). The Company states that the consultation process has identified issues of potential consequence to the COS study and RDA proposal. FortisBC believes that allowing additional consultation to further explore stakeholder concerns will make the eventual regulatory process less contentious, more efficient, and potentially less costly. FortisBC requests delaying the filing of the COS study and RDA by one month to provide additional time for consultation; and I. The Commission has considered FortisBC’s request and determines that extension of the filing dates is in the public interest.
