Nicholls, Commissioner ) O R D E R WHEREAS: A. On May 31, 2002, Toby Creek Utilities Co. Ltd. (“TCU”) applied to obtain permanent rates for its propane gas distribution system at Panorama Mountain Village, British Columbia (“the Resort”), and requested approval of General Tariff Terms and Conditions of Service (the Application”); and B. TCU is a wholly-owned subsidiary of Intrawest Corporation, which transferred the original propane facilities to TCU for $25,311 in July 2000; and C. TCU signed a 10-year agreement with BCG Services Inc. to supply gas storage and utility services to the propane grid system at the Resort that will minimize costs to customers for utility operations; and D. The Application sets out the General Terms and Conditions of Service and rates charged customers including standard charges and new service line extension costs; and E. The Commission issued Certificate of Public Convenience and Necessity Order No. C-9-02 dated June 13, 2002, to TCU to construct and operate a propane gas distribution system at the Resort; and F. The Commission has reviewed the application and supporting documentation and has determined that approval of General Terms and Conditions of Service and rates, effective June 1, 2002, are necessary and in the public interest. .../2
2 NOW THEREFORE the Commission, pursuant to Sections 58, 60 and 61 of the Utilities Commission Act, orders as follows: 1. The Commission approves for TCU the Gas Tariff, General Terms and Conditions of Service as filed in its May 31, 2002 application, effective June 1, 2002. 2. The Commission approves for TCU the charges in the schedules as filed in its May 31, 2002 application, effective June 1, 2002. 3. TCU is to provide all customers with information about the propane grid system rates, standard charges and the General Terms and Conditions of Service.
