IN THE MATTER OF

and

An Application by Terasen Gas Inc.

for Approval of the Special Provisions

for the United Energy Trading, LLC Gas Electronic Data Interchange Base Contract

BEFORE:               L.F. Kelsey, Commissioner                                           April 29, 2010

WHEREAS:

A.      On August 26, 2009 the British Columbia Commission (Commission) by Letter L-58-09, accepted the Terasen Gas Inc. (Terasen Gas) 2009/10 Annual Gas Contracting Plan; and

B.      On April 20, 2010, Terasen Gas filed with the Commission a fully executed copy of a Gas Electronic Data Interchange (EDI) Base Contract with amendments called “Standard Provisions of the Gas EDI contract for Short Term Sale and Purchase of Natural Gas General Terms and Conditions” negotiated between Terasen Gas and United Energy Trading, LLC; and

C.      Terasen Gas uses the Gas EDI Base Contract dated October 26, 2000 for natural gas contracting.  The Special Provisions for each gas transaction is confirmed via a deal sheet described in Section 9 of the Gas EDI Standard Contract; and

D.      Terasen Gas has requested that the documents associated with the filing remain confidential due to their commercially sensitive nature as described in the filing’s cover letter; and

E.       The Commission has reviewed the Terasen Gas’ filing and is satisfied that the Special Provisions to the Gas EDI Base Contract for Short Term Sale and Purchase of Natural Gas between United Energy Trading, LLC and Terasen Gas is consistent with the Annual Gas Contracting Plan.

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the Commission’s Rules for Natural Gas Energy Supply Contracts, the Commission orders as follows:

1.    The Commission accepts for filing the executed copy of the Special Provisions of the Gas EDI Base Contract negotiated between Terasen Gas Inc. and United Energy Trading, LLC for the Short Term Sale and Purchase of Natural Gas.

2.    The Commission will keep confidential the documents associated with the filing due to their commercially sensitive nature as stated in Terasen Gas’ cover letter.
