IN THE MATTER OF

the Utilities Commission Act, R.S.B.C. 1996, Chapter 473

 

and

 

An Application by Terasen Gas Inc.

for Mist Storage Contracts and a Related Delivery Agreement

 

 

BEFORE:               D.A. Cote, Commissioner                                              May 20, 2010

 

 

WHEREAS:

 

A.      On August 26, 2009, the British Columbia Utilities Commission (Commission) by Letters L-58-09 and L-59-09 accepted the Terasen Gas Inc. (Terasen Gas) 2009/10 Annual Gas Contracting Plan and the Terasen Gas (Vancouver Island) Inc. (TGVI) 2009/10 Annual Contracting Plan, respectively; and

 

B.      On May 3, 2010, Terasen Gas filed with the Commission executed copies of agreements for Mist Storage and redelivery of gas related to Mist Storage.  In addition, Terasen Gas filed an agreement to sublease Mist Storage to TGVI (collectively the Filing); and

 

C.      The Commission has reviewed the Terasen Gas’ filing and is satisfied that the gas storage and delivery agreements should be accepted; and

 

D.      Terasen Gas has requested that the Filing and associated documents remain confidential due to their commercially sensitive nature.

 

 

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the Commission’s Energy Supply Contract Rules, the Commission accepts for filing the three contracts described as follows:

 

1.       The amended Mist Storage Agreement H between Northwest Natural Gas Company and Terasen Gas Inc.

 

2.       The Mist Storage and Huntingdon Exchange Agreement between Shell Energy North America (US), L.P. and Terasen Gas Inc.

 

3.       The replacement Mist Storage Agreement between Terasen Gas Inc. and Terasen Gas (Vancouver Island) Inc.

 

 

 

 

4.    The Commission will keep confidential the Filing and associated documents identified in this Order.
