An Application by Terasen Gas Inc.

for Approval of Special Provisions for the

Tenaska Marketing Ventures Gas Electronic Data Interchange Base Contract

O  R  D  E  R

 

WHEREAS:

 

A.       On August 26, 2009 the British Columbia Utilities Commission (the “Commission”), by Letter No. L-58-09, accepted the Terasen Gas Inc. (“Terasen Gas”) 2009/10 Annual Gas Contracting Plan; and

 

B.       On January 4, 2010 Terasen Gas filed with the Commission a fully executed copy of a Gas Electronic Data Interchange (“EDI”) Base Contract with amendments called, “Standard Provisions of the Gas EDI contract for Short Term Sale and Purchase of Natural Gas General Terms and Conditions” negotiated between Terasen Gas and Tenaska Marketing Ventures; and

 

C.       Terasen Gas uses the Gas EDI Base Contract dated October 26, 2000 for natural gas contracting.  The Special Provisions for each gas transaction is confirmed via a deal sheet described in section 9 of the Gas EDI Standard Contract; and

 

D.       The Commission has reviewed the Terasen Gas filing and is satisfied that the Special Provisions to the Gas EDI Base Contract for Short Term Sale and Purchase of Natural Gas between Tenaska Marketing Ventures and Terasen Gas is consistent with the Annual Gas Contracting Plan.

 

 

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the Commission’s Energy Supply Contract Rules, the Commission accepts for filing the executed copy of the Special Provisions of the Gas EDI Base Contract negotiated between Terasen Gas Inc. and Tenaska Marketing Ventures for the Short Term Sale and Purchase of Natural Gas.
