O R D E R

 

WHEREAS:

 

A.    On October 28, 2009, Terasen Gas Inc. (Terasen Gas) applied (the Application) to the British Columbia Utilities Commission (the Commission), pursuant to section 45 of the Utilities Commission Act (the Act), for a Certificate of Public Convenience and Necessity for the purchase (the Tilbury Property Purchase) of a parcel of land known as the Northwest Hardwoods Site located at 6939, 7150 Tilbuy Road, and 7505 Hopcott Road in the Tilbury Industrial Area of Delta, BC (the Property) adjacent to the Tilbury LNG Facility; and

 

B.     Following a Written Public Hearing, the Commission Panel issued Order G-28-10 with Reasons for Decision dated February 23, 2010, stating that the Tilbury Property Purchase was in the public interest, subject to conditions; and

 

C.     By letter dated March 9, 2010, Terasen Gas filed an Application for Reconsideration (Reconsideration Application) of Order G-28-10; and

 

E.     The Commission heard the Reconsideration Application by way of a written process and on April 9, 2010, the Commission issued Order G-68-19 with Reasons for Decision requiring Terasen Gas to file written confirmation of the acceptance of the amended conditions.  Terasen Gas, by letter dated April 14, 2010, accepted the conditions as amended; and

 

F.     On April 28, 2010, the Commission issued Certificate of Public Convenience and Necessity Order C-2-10 for the Terasen Gas Tilbury Property Purchase; and

 

G.    By letters dated March 3 and April 14, 2010, the British Columbia Public Interest Advocacy filed a Participant Assistance/Cost Award application (PACA) on behalf of its client the British Columbia Old Age Pensioners’ Organization et al., with respect to its participation in the Tilbury Land Purchase and Tilbury Reconsideration proceedings; and

 

H.    By letters dated March 15 and July 20, 2010, the Commercial Class Energy Consumers Association of British Columbia applied for a PACA award with respect to its participation in the Tilbury Land Purchase and Tilbury Reconsideration proceedings; and

 

I.      By letters dated July 20 and 21, 2010, Terasen Gas advised the Commission that it is of the view that the applications are not unreasonable and has no objection to the applications or the amounts sough therein; and

 

J.      The Commission has reviewed the PACA Applications with regard to the criteria and rates set out in Order G‑72-07.

 

 

NOW THEREFORE the Commission orders as follows:

 

1.     Pursuant to section 118(1) of the Utilities Commission Act, the Commission approves the following cost awards:

 

Terasen Gas Tilbury Land Purchase CPCN

British Columbia Old Age Pensioners’ Organization et al

$5,180.44

Commercial Class Energy Consumers Association of British Columbia

$7,087.51

 

 

Terasen Gas Tilbury Reconsideration

Award

British Columbia Old Age Pensioners’ Organization et al

$2,688.00

Commercial Class Energy Consumers Association of British Columbia

$1,336.13

 

 

2.      Terasen Gas is directed to reimburse the above-noted Participants in a timely manner.
