An Application for Approval of Pacific Northern Gas Ltd./Village of Fraser Lake Franchise Agreement

CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY

 

WHEREAS:

 

A.      On September 14, 2010, Pacific Northern Gas Ltd. (PNG) applied for British Columbia Utilities Commission (Commission) approval of a Franchise Agreement dated August 13, 1988 (Agreement) between PNG and the Village of Fraser Lake (Municipality) pursuant to section 45 (7) of the Utilities Commission Act (Act);

 

B.      The Agreement that sets out the terms and conditions under which PNG can exercise its rights to use the Public Lands of the Municipality to supply and distribute gas to consumers within the Municipality, effective July 9, 1994 for a term of 21 years;

 

C.      Under section 2.1(b) of the Agreement, the Municipality was required to obtain enabling and validating legislation;

 

D.      On July 8, 1994, the Municipalities Enabling and Validating Act (No. 2), S.B.C. 1990, c. 61 was amended to confirm and validate the Agreement;

 

E.       The Agreement is in the same form as the franchise agreement between PNG and six municipalities;

 

F.       The Commission has reviewed the Application and has determined that the Agreement between PNG and the Village of Fraser Lake should be approved.

 


 

NOW THEREFORE pursuant to section 45(7) of the Utilities Commission Act, the Commission approves the Agreement between PNG and the Village of Fraser Lake for the period July 9, 1994 to July 8, 2014.
