O R D E R
WHEREAS:
A. By Order E-18-08 dated October 23, 2008, the British Columbia Utilities Commission (the Commission) accepted a propane supply agreement dated June 3, 2008 for the supply of liquid propane to Sun Peaks Utilities Co., Ltd. (SPUCL) for the period April 1, 2008 to March 31, 2010 between MP Energy Partnership (MP Energy) and Terasen Utility Services Inc.;
B. On August 3, 2010, SPUCL applied for acceptance of a Propane Supply Agreement dated March 24, 2010 between MP Energy and Terasen Utility Services Inc. for the supply of liquid propane to SPUCL for the period April 1, 2010 to March 31, 2012 (the Agreement);
C. On September 17, 2010, SPUCL submitted an amendment to its August 3, 2010 filing;
D. SPUCL states that it intends to implement a price hedging strategy for a portion of its propane supply;
E. SPUCL has requested that the Agreement be kept confidential due to its commercially sensitive content;
F. The Commission has reviewed the SPUCL submission, and has determined that the Agreement should be accepted for filing.
NOW THEREFORE pursuant to section 71 of the Utilities Commission Act, the Commission accepts the Agreement for filing and requests that SPUCL file a report with the Commission by November 28, 2010 that confirms the propane price paid for the hedged component of the winter propane supply. The Commission will hold information specific to the Agreement confidential.
