O  R  D  E  R

WHEREAS:

 

A.      On October 13, 2010, Terasen Gas (Vancouver Island) Inc. (TGVI) submitted an application (the Application) to the British Columbia Utilities Commission (the Commission), pursuant to sections 45 and 46 of the Utilities Commission Act (the Act), for a Certificate of Public Convenience and Necessity to acquire the property known as Langford Parkway that consists of approximately 3.6 acres of freehold land located at 1017 – 1027 Langford Parkway, Langford, BC (the Land Acquisition) and construct a new regional facility on the site to be acquired (the Construction Project);

 

B.      The lease for the existing regional facility, located at 320 Garbally Road, Victoria, BC, expires on October 31, 2012;

 

C.      TGVI has considered five alternatives in the Application and determined that the Land Acquisition and Construction Project, with a total capital cost of $13.2 million excluding Allowance for Funds Used During Construction, is the preferred solution;

 

D.      On June 15, 2010, TGVI entered into a conditional contract to acquire the Langford Parkway Property that is subject to Commission approval being obtained by December 31, 2010.  TGVI can extend the deadline by 30 days;

 

E.       TGVI recommends a written hearing process is appropriate for the review of the Application and proposes a regulatory timetable;

 

F.       The Commission determines that a written public hearing is needed for the regulatory review of the Application.

 

 

NOW THEREFORE the Commission orders as follows:

 

1.       The Application will be examined by a Written Public Hearing process, in accordance with the Regulatory Timetable that is attached as Appendix A to this Order.

 

2.       TGVI is to publish, as soon as possible, in display-ad format, the Notice attached as Appendix B to this Order, in the Vancouver Sun, the Province, and the Victoria Times Colonist, to provide adequate notice to customers served in the affected service area.

 

3.       The Application, together with any supporting materials, will be made available for inspection at the TGVI Victoria – Garbally office, 320 Garbally Road, Victoria, BC, V8T 2K1; Terasen Gas Inc. Office, 16705 Fraser Highway, Surrey, BC, V4N 0E8; and at the Commission office, Sixth Floor, 900 Howe Street, Vancouver, B.C., V6Z 2N3 and will also be available on the Commission website at www.bcuc.com and the Terasen Gas Inc. website at www.terasengas.com.

 

4.       Interveners or Interested Parties will register with the Commission, in writing or electronic submission, by November 10, 2010.  Interveners should state the nature of their interest in the Application and identify generally the nature of the issues that they intend to pursue during the proceeding and the nature and extent of their anticipated involvement in the review process.

NOTICE OF APPLICATION AND WRITTEN PUBLIC HEARING

 

 

The APPLICATION

 

On October 13, 2010, Terasen Gas (Vancouver Island) Inc. (TGVI) applied to the British Columbia Utilities Commission (the Commission) for a Certificate of Public Convenience and Necessity to acquire the property known as Langford Parkway that consists of approximately 3.6 acres of freehold land located at 1017 – 1027 Langford Parkway, Langford, BC and construct a new regional facility with a total capital cost of $13.2 million excluding Allowance for Funds Used During Construction (the Application).  The location of the proposed building site is shown in the map below.

 

 

THE REGULATORY PROCESS

 

The Commission has established a Written Public Hearing and Regulatory Timetable for the regulatory review of the Application.  The Regulatory Timetable can be viewed on the Commission’s web site at www.bcuc.com.

 

 

INTERVENTION

 

Persons who expect to actively participate in the TGVI proceeding should register as Interveners with the Commission, and should identify the issues that they intend to pursue as well as the nature and extent of their anticipated involvement in the review process.  Interveners will receive email notice of all correspondence, filed documentation and should provide an e-mail address, if available.

 

Persons not expecting to actively participate, but who have an interest in the proceeding, should register as Interested Parties. 

 

Interveners and Interested Parties should register in writing, no later than Wednesday, November 10, 2010.  Notification by mail, courier delivery, facsimile or e-mail is acceptable.

 

All submissions and/or correspondence received from active participants or the general public relating to the Application will be placed on the public record and posted to the Commission’s web site.
