O R D E R

 

WHEREAS:

A.    On October 4, 2010, British Columbia Hydro and Power Authority (BC Hydro) filed its Customer Baseline (CBL) Load F2010 and F2011 Application (the F10/F11 CBL Application) with the British Columbia Utilities Commission (the Commission) requesting the following approvals under the Utilities Commission Act (the Act):

 

i.         Final Adjusted F2010 CBL’s, effective April 1, 2009, and the placement of certain customers on Rate Schedule 1823A during F2010, pursuant to sections 58 to 61 of the Act;

 

ii.        Interim F2011 CBL’s, effective April 1, 2010, and the continuation of, or placement of, certain customers on RS 1823A during F2011, pursuant to sections 58 to 61, 89 and 90 of the Act;

 

iii.    Continuance of Interim F2010 CBL’s for two specific customers with unique circumstances;

 

B.     In the F10/F11 CBL Application BC Hydro stated that per section 6.2.1 of Tariff Supplement No. 74 – CBL Guidelines, BC Hydro has submitted all F2010 and F2011 CBL determinations to the customer for review and comment prior to the filing of the F10/F11 CBL Application.

 

 

NOW THEREFORE the Commission orders as follows:

 

1.       Pursuant to Letter L-94-10 issued concurrently with this Order, the Commission requests comments by December 17, 2010 from customers on the Adjusted F2010 and Interim F2011 CBL’s proposed for them by BC Hydro.  In the event that any customer does not so advise the Commission by December 17, 2010, the Commission will conclude that the customer agrees with the CBL’s proposed by BC Hydro.

 

 


2.       If there are any disputes pursuant to item 1 above, the Commission will establish a process to review the disputes.

 

3.       BC Hydro is directed to provide a copy of this Order and Letter L-94-10 to all RS 1823 customers by December 3, 2010.

 

4.       Once the Commission has approved the final CBLs, BC Hydro is to make any necessary billing adjustments as set out in section 6.2.3 of Tariff Supplement No. 74.
