Project No. 3698566/Order G-172-09

__________Application for Capital Structure and Equity Risk Premium________

On January 19, 2010, the Commission issued Order G-13-10 and set out the Regulatory Timetable for the review of the Application for Capital Structure and Equity Risk Premium by Written Hearing.  Commission Order G-13-10 also provided an opportunity for the Commission Panel to determine if the review would proceed by way of a Negotiated Settlement Process (NSP), to take place on April 8 and 9, 2010.

Following the recently completed NSP for PNG’s 2010 Revenue Requirements application and two rounds of Information Requests to PNG, all major participants now express to the Commission a desire to proceed with the review of this Application by way of an NSP.

The Commission Panel accepts the parties’ preference for an NSP.  In order to accommodate the various schedules of the major participants, this Letter varies the original dates April 8 and 9, 2010 set out in Order

G-13-10 to Monday and Tuesday on April 26 and 27, 2010.  Furthermore, should the NSP be unsuccessful, the dates for Written Argument would be as follows:

PNG Final Argument

Friday, May 7, 2010

Intervener Arguments

Monday, May 17, 2010

PNG Reply Argument

Tuesday, May 25, 2010

                                                                                                                                Yours truly,
