IN THE MATTER OF

An Application by Arrow Lakes Power Corporation and Brilliant Power Corporation

For Registration as Responsible Entities for Certain Functions required for Compliance with Mandatory Reliability Standards

O  R  D  E  R

WHEREAS:

 

A.    Order G-123-09 approved the Registration Manual for Entities subject to adopted Mandatory Reliability Standards and required that Entities subject to the standards register with the Commission by December 31, 2009; and

 

B.       The Registration Manual requires that the Western Electricity Coordinating Council (WECC) in its role as the Mandatory Reliability Standards Administrator, review and recommend registration for all applicable Entities and allows 21 days for Entities to comment to the Commission on the Western Electricity Coordinating Council’s recommendations; and

 

C.       On January 14, 2010 WECC recommended to the Commission that:

 

  The Commission approve Arrow Lakes Power Corporation’s registration for the functions of Transmission Operator, Transmission Owner, Generator Operator, and Generator Owner;

 

  The Commission approve Brilliant Power Corporation’s registration for the functions of Transmission Operator, Transmission Owner, Generator Operator, and Generator Owner; and

 

D.       On February 17, 2010 Columbia Power Corporation disputed the WECC’s recommendations with respect to the Transmission Operator and the Generator Operator functions for Arrow Lakes Power Corporation and Brilliant Power Corporation and, by letter dated February 19, 2010 to the WECC and FortisBC the Commission requested comments regarding Columbia Power Corporation’s objections; and

 

E.        On March 1, 2010 the Commission by Order G-29-10 deferred the registration for the function of Generator Operator and Transmission Operator for the Arrow Lakes Power Corporation and the Brilliant Power Corporation until a later date; and

 

F.        The Commission received responses from the WECC on February 26, 2010 and from FortisBC on March 3, 2010; and

 

G.       The Columbia Power Corporation provided a letter of further clarification to the Commission on March 15, 2010.

 

 

NOW THEREFORE the Commission orders as follows:

 

1.         Functional registration for Arrow Lakes Power Corporation for Generator Operator and Transmission Operator is approved as recommended by the Western Electricity Coordinating Council.

 

2.         Functional registration for Brilliant Power Corporation for Generator Operator and Transmission Operator is approved as recommended by the Western Electricity Coordinating Council.

 

3.         The Commission will revisit the registration of Arrow Lakes Power Corporation and Brilliant Power Corporation as Generation Operator and Transmission Operator if Assignment Agreements are concluded between these corporations and FortisBC that, in the view of the Commission, are sufficient to assign the responsibility for these functions.
