By letter dated March 18, 2010, Mandell Pinder on behalf of the First Nations Interveners (Kwikwetlem, Stó:lō Tribal Council, Hwlitsum First Nation, Cooks Ferry et al., SHAC, and NNTC/ONA/Upper Nicola), sought from the Commission an extension for filing Intervener submissions to March 29, 2010 (Exhibit C5-25).  Previously, the Commission Panel had set filing dates of Monday, March 22, 2010 for Intervener Argument (Transcript Volume 16, page 2365), Monday, April 19, 2010 for Reply Argument and April 28 and 29, 2010 for an Oral Phase if one is needed.

 

Mandell Pinder explains legal counsel for the First Nations Interveners have been working to develop common submissions in relation to common issues.  The collective view of counsel for the First Nations Interveners is that more time is needed to complete the Intervener Arguments.

 

The Commission Panel accepts the First Nations Interveners’ request for an extension.  Intervener Arguments are to be filed on or before noon on Monday, March 29, 2010.

 

BCTC, BC Hydro and any other Interveners supporting BCTC’s position in the proceeding may request an extension to the Reply Argument deadline of April 19, 2010.  This extension request, if any, should be submitted no later than April 12, 2010.  The dates for the Oral Phase will remain unchanged due to other scheduled Commission hearings.
